June Court 1763 232 Whereupon a certain John Parramore present here in court in his proper person undertook for the & each of them said William Hasten, Solomon Hasten & Moses Creeman ^ and assumed upon himself that if it should Happen that Judgement in the plea afd should be rendered for the said Outerbridge Horsey against the afd William, Solomon, & Moses or that the said William, Solomon, & Moses should be therein convict that then they the said William, Solomon, & Moses either of them should pay and satisfy unto the afd Outerbridge Horsey the Judgement of the court thereupon or render their & each of their bodies in Execution of such Judgement to the prison of the sheriffe of the county afsd in satisfaction thereof or that he the said John Parramore will do the same for them &c And the afd William Hasten, Solomon Hasten & Moses Creeman & each of them come and defend the force & Injury when &c & say that they or either of them cannot deny the action afd of the afd Outerbridge Horsey (nor but that the writing obligatory afd is the deed of them the said William, Solomon, & Moses & each of them) nor but that they owe the afd Outerbridge Horsey the afd Fourteen pounds ten shillings & ten pence in manner and form as the afd Outer -bridge above against them hath declared Therefore it is considered that the afd Outer -bridge Horsey Recover against the afd. William Hasten, Solomon Hasten, & Moses Creeman his Debt afd and his damages by occasion of the detention of that same Debt to 310 pounds of Tobacco to the same Outerbridge Of his Assent by the court here adjudged & the afd William, Solomon & Moses in Mercy &c Stay Exn untill Aug Cot
Justices of his Lordships county court of Somerset to be held at princess Ann Town the third tuesday of June Anno Dom. one thousand seven hundred & sixty three to answer unto George Farrington of a plea of trespass upon the case & So Forth & the same Day is given to the afd George Farrington here &c Att which day here came the afd George Farrington by George Hayward his Attorney and the she -riff to witt Ephraim Willson now here returned that he had taken the afd Peter Magee Junr whose body here at this day he had ready to answer the afd. George Farrington of the plea afd. as to him it was commanded &c And hereupon the afd George Farring -ton complained against the afd Peter Magee Junr in the plea afd. in form following Somerset fst Peter Magee Late of Somerset County Planter was attached to answer unto George Farrington of a plea of trespass upon the case & So Forth And Whereupon the said George Farrington by George Hayward his Attorney complains that whereas the said Peter after the First day of May in the year of our Lord one thousand Seven hundred & five to wit on the Eighteenth day of June in the year of our Lord God one thousand seven hundred sixty & Two at the county afd. made his certain note in writing commonly called a promissary Note with his proper name thereto subscribed bearing date the same day and year afsd and the Same Note to the same George Farrington then and there did deliver by which Note the said Peter did promise and oblige himself to pay or cause to be paid to the said George by the Name of George Farrington the full & Just sum of Eight pounds to be paid to the said George Farrington by the first day of January Next Ensuing the date of the said Note for Value Received of the said George Farrington by reason whereof as also by force of the statute in such case made & provided the said Peter became liable to to pay to the said George Farrington the said sum of eight pounds in the said Note mentioned according to the Tenor & effect of the said Note, and being so liable the said Peter in consideration thereof afterwards to witt the same day & year last afd at the county Afsd. |
