June Court 1763 230 was Indebted unto the said Outerbridge in the sum of four pounds and six pence Current Money of Maryland for the articles and things in the account hereto anexed mentioned and so thereof In -debted being the said said George in consideration thereof afterwards )to wit) the same day and year afd at the county afd upon himself did assume and to the said Outerbridge then and there faithfully did promise that when afterwards he should be thereunto required the afsd sum of four pounds and six pence Current money afsd to the said Outerbridge he would well and faithfully pay and content Nevertheless the said George his promise & assumption afsd in form afsd made little regarding but minding and fraudu -lently Intending the same Outerbridge in that part craftily and Subtily to deceive and defraud he the said George the afsd sum of four pounds and six pence Current Money afd to the same Outerbridge hath not paid or him for the same in any sort Contented altho the said George afterwards (to wit) the same day and year afsd at the county afsd by him the said Outerbridge was thereunto Requested but the said George the same to do hitherto altogether hath refused and still doth Refuse and unjustly deny whereby the same Outerbridge says he is worse and hath damage to the Value of Eight pounds and one shilling like Money & thereof he brings suit and so forth
was willing to give the said Outerbridge Horsey special Bail to the Suit afsd Thereupon a certain William Hasten of Somerset County planter present here in court in his proper person undertook for the said George Hasten and assumed upon himself that if it should happen that Judgement in the plea afd should be rendred for the said Outerbridge Horsey against the afd George Hasten or that he the said George should be therein convict that then he the said George should pay and satisfy unto the afd Outerbridge Horsey the Judgement of the court thereupon or render his body in Execution of such judgement to the prison of the sheriff of the county afd in satisfaction thereof or that he the said William Hasten will do the same for him &c And hereupon the said George Hasten by Josiah Polk his Attorney comes and defends the force & Injury when &c and saith that he cannot deny the action afsd of the afd Outerbridge Horsey nor but that he did assume upon himself in manner and form as the afd Outerbridge Horsey above against him hath complained and as to the Damage of the same Outerbridge by him by occasion of the premises in that part sustained the same George Hasten saith and acknowledgeth that the afd Outerbridge hath sustained damages by occasion of the premises beyond his costs and charges by him about his suit in that part opposed to three pounds nineteen shillings & six pence Curt. Money and not more and because the afd. Outerbridge Horsey deny's not this but the same Allegation grants to be true prays Judgement for these damages above acknowledged together with his costs and charges afd to him to be adjudged &c Therefore by consent of the parties afd it is considered that the afd Outerbridge Horsey Recover against the afd George Hasten his Damages afd to the afd three pounds Nineteen shillings and six pence Curt. Money by the afd George in form afd acknowledged as also |
