he might have his body before the Justices of his Lordships county court of Somerset To be held at princess Ann Town the third tuesday of June Anno Domini one thousand seven hundred and sixty three to answer unto George Hardy of a plea that he render unto him sixty pounds current Money of Maryland which to him he owes and unjustly detains &c and the same day is given to the afd George here and So forth And hereupon the afd George Hardy declared against the afd Christopher Piper in the plea afd in form following Somerset to wit Christopher Piper Late of Somerset county planter otherwise called I Christopher Piper of the county & province afd Planter was sumoned to answer unto George Hardy of a plea that he render unto him Sixty pounds current money of Maryland which to him he owes and unjustly detains and So Forth And Whereupon the said George Hardy by George Hayward his attorney saith that whereas the said Christopher on the Ninth day of February in the year of our Lord one thousand seven hundred sixty and two at Somerset County afd by his certain writing obligatory which the said George Hardy with the seal of the said Christopher sealed here into Court brings the date whereof is the same day and year afsd did acknow -ledge himself to be held and firmly bound unto the said George Hardy in the aforesaid Sum of sixty pounds current Money of Maryland to be paid unto the said George Hardy when he the said Christo -pher by the said George Hardy should be thereunto Required Nevertheless the said Christopher tho often Required the said Sixty pounds Current Money afd to the said George Hardy hath not Rendred but the same to him hitherto to render hath denyed and still doth deny and unjustly detain, wherefore the said George Hardy saith he is worse and hath damage to the Value of Sixty Pounds current money of Maryland and thereof he brings Suit and so Forth pledges &c J Doe R Roe A Copy of the foregoing declaration was made & sent To be served on the deft in order for speedy tryall Att which day here came the afsd George Hardy by George Hayward his Attorney & the sheriff to witt Ephraim Wilson now here returned that he had taken the afd Christopher Piper whose body here at this day he had ready to answer the afd George Hardy of the plea afd as to him it was commanded and further the same sheriffe returned that he had served the afd Christopher Piper with a Copy of the foregoing declaration according to act of assembly in such case provided &c And thereof Christopher Piper by Littleton Dennis his attorney comes and defends the Force and injury when &c and saith that he cannot deny the action afsd of the afd George Hardy (nor but that the writing obligatory afd: is the Deed of him the said Christopher Piper) nor but that he owes the afd George Hardy the afd Sixty pounds in manner and form as the afd George Hardy above against him hath declared Therefore it is considered that the afd. George Hardy recover against the afd Christopher Piper his Debt afd and his damages by occasion of the detention of that same Debt to 242 pounds of tobacco to the Same George of his assent by the court here adjudged & the afd Christopher in mercy &c
