June Court 1760 23 said Robert on ye Ninth day of June Anno Dom. MDCCLVii at ye. County afd. by his Certain Bill obligatory which ye. said John Sealed with ye. seal of ye. said Robert here in Court Shews whose date is ye. Day and year afd. Acknowledged himself to be held And firmly bound unto ye. said John Cann or his Assigns in ye. Sum of ten pounds Current money of Virginia and that at or on ye. first day of October next ensuing ye. date of ye. said Bill obligatory to which payment well and Truly to be made and Done ye. said Robert bound himself firmly by ye. said bill Nevertheless ye. said Robert altho often required ye. Sum of money afd. of ye. value afd. to ye. afd. John hath not paid but ye. same to him to pay hitherto hath gainsayed and Still doth gainsay to ye. Damage of ye. said John twenty pounds Current money of Maryland and thereof he brings Suit &c. Pledges &c. J. Doe & R. Roe A Copy of ye. foregoing declaration was made & Sent to be Served on ye. Deft. in order for Spedy Tryall Att which day here Came ye. afd. John Cann by Josiah Polk his Atty. and ye. Sherriffe to wit John Dennis Gent. now here returned that he had taken ye. afd. Robert Taylor whose Body here at this Day he had ready to Answer ye. afd. John Cann of ye. afd. plea as to him it was Commanded And further ye. same sherriffe returned that he had Served ye. afd. Robt. Tyalor with a copy of ye. foregoing declaration According to Act of Assembly in such Case provided &c. Whereupon ye. said Robert Taylor at ye. prayer of ye. afd. John Cann is adjudged to give Special Bail to ye. Action afd. Thereupon A Certain Nathaniel Whitaker of Somerset County Gent. Present here in Court in his proper person undertook for ye said Robert Taylor that if it Should happen that judgment in ye. plea afd. Should be rendered for ye. said John Cann against ye. afd. Robert Taylor or that he ye. said Robert should be therein Convict that then he ye. said Robert should pay & Satisfie unto ye. afd. John the judgment of ye. Court thereupon or render his Body in Execution of such Judgment to ye. Prison of ye. sherriffe of ye. County afd. in satisfaction thereof or that he the said Nathaniell will do ye. same for him &c. And ye. afd. Robert Taylor by Littleton Dennis his Atty. Comes and Defends ye. force and Injury when &c. and prays Leave thereof to Imparle here untill next Court to be held at Princes Ann Town ye. third Tuesday of June then next following & he hath it & ye. same day is given to ye. afd. John here also &c. Att Which day here Came as well ye. afd. John as ye. afd. Robert by their Attys afd. and hereupon ye. said Robert as before Defends ye. force & Injury when &c. And Saith that he Cannot deny ye. Action afd. of ye. afd. John Cann nor but that the Writing Obligatory afd. is ye. Deed of him ye said Robert Taylor nor but that he owes ye. afd. John Cann ye. afd. Sum of ten pounds Current money of Virginia of ye. value of twelve pounds Current money of Maryland in manner & form as ye. afd. John Cann above against him hath declared Therefore it is Considered that ye. afd. John Cann recover Against ye. afd. Robert Taylor his Debt afd. & his Damages by Occasion of ye. Ditention of that same Debt to 207 Pounds of Tobacco to ye. same John of his Assent by ye. Court here adjudged & ye. afd. Robert in Mercy &c. |
