June Court 1760 22 Bill Obligatory which ye. said Samuel Wilkins Sealed with the Seal of ye. said John hereto ye. Court Shews whose date is ye. day & year afd. did acknowledge himself to be held and firmly bound unto ye. said Samuel Wilkins by ye name of Samuel Wilkins of Somerset County in ye. said Sum of fourteen pounds fourteen Shillings and ten pence Current money of Maryland to be paid unto ye. said Samuel when he ye. said John should be thereto afterwards required And to ye. payment thereof well and truly to be made and Done did bind himself firmly by the said Bill Nevertheless ye. said John altho often thereto afterwards at ye County afd. required ye said Sum of fourteen pounds fourteen shillings & ten pence Current money of Maryland to ye Said Samuel hath not rendered but ye. Same to him to render hitherto hath denyed and still doth deny & ye. Same from him unjustly detain Wherefore ye. said Samuel Saith he is worse and hath Damage to ye. Value of twenty Pounds Current money of Maryland and therefore he brings Suit and so forth Pledges &c J. Doe & R. Roe And ye. afd. John Covington by William Hayward his Atty Comes and Defends ye force and Injury when &c And Saith that he Cannot deny ye. Action afd. of ye. afd. Samuell Wilkins nor but that the Writing Obligatory afd. is ye. Deed of him ye. said John Covington nor but that he owes ye. Same Samuell Wilkins ye. afd. Sum of fourteen pounds fourteen shillings and ten pence Curt. money in manner & form as the afd. Samuel Wilkins above agt. him hath declared nor Can he say but that ye. same Samuel ought to recover his Damages agt. him by Occasion of ye. Detention of ye Same Debt beyond his Costs and Charges by him About his Suit in this part apposed to Six Shillings & two pence farthing Curt. money and not more & whereupon the said Samuel prays Judgt. for his Debt afd. and his Damages by Occasion of ye. Detention of tat Same Debt to him to be adjudged &c. Therefore it is Considered that the afd. Samuel Wilkins Recover Against the afd John Covington his debt afd. and his Damages by Occasion of the detention of that Same debt to Six Shillings and Two pence farthing 276 Curt. money & Pounds of Tobacco to the Same Samuel of his Assent by the Court have Adjudged and the afd. John in Mercy &c
Tuesday of March Anno Dom. one thousand Seven hundred and Sixty to answer unto John Cann of a plea of that he render him the sum of ten pounds Current money of Virginia of ye Value of twelve pounds Current money of Maryland which from him he unjustly Detains &c. And ye. same day is Given to ye. afd. John here &c. And hereupon ye. said John Cann Declared agt. ye afd. Robt. Taylor in ye. plea afd. in form following Somerset to wit Robert Taylor Late of Somerset County Planter Otherwise Called me Robert Taylor was Summoned to Answer unto John Cann of A plea that he render him the Sum of ten pounds Current money of Virginia of ye. value of twelve pounds Current Money of Maryland which from him he unjustly Detains &c. And Whereupon ye. said John by Josiah Polk his Atty. Says thas whereas ye said |
