March Court 1763 222 Whereupon the Said John Records at the prayer of the afd. Michael Thorp is Adjudged to Give Special Bail to the Action afd. of the Sheriff of the County afd. there to Remain &c And the afd. John Records in his proper person in Custody afd. Comes and defends the force and Injury when &c. and Saith that he Cannot deny the Action afd. of the afd. Assume upon himself in Manner and form as the afd Michael Above Against him hath Complained and as to the damage of the Said Michael him by Acknowledgeth that the afd. Michael hath Sustained Damages by Occasion of the Premisses beyond his Costs and Charges by him about his Suit in that part Apposed to Nine pound five Shillings and Ten pence Current Money and not More and because the afd. John Denys not this but the Same Allegation Grants to be true Prays Judgment for those Damages Above Acknowledged together with his Costs and Charges afd. to him to be Adjudged &c. Therefore by Consent of the Parties afd. it is Considered that the afd. Michael Thorp Recover Against the afd. John Records his Damages afd to the afd. Nine Pound five Shillings and Ten pence Current Money by the Same John in form afd. Acknowledged as also 195 : Pounds of Tobacco for his Costs and Charges to the Same Michael at his Request by the Court now here of the Assent of the parties afd. Adjudged which Certain damages in the whole Amount to Nine pound five Shillings and Ten pence Curt Money and John Pounds of Tobacco and the afd. ^
Anno Dom. one thousand seven hundred and sixty three to answer unto Shiles Moor of a plea of Trespass upon the case &ca. & the Same day is given to the afsd. Shiles here &c Att which Day here came the afsd Shiles Moor by Josiah Polk his Attorney and the sheriff to wit Ephraim Wilson now here returned that he had taken the afsd. John Records whose body here at this day he had ready to answer the afsd. Shiles Moor of the afsd. plea as to him it was Commanded &c Whereupon the said Shiles Moore complained against the afsd. John Records in the plea afsd. in form following Somerset fst John Records late of Somerset County Planter was attached to answer unto Shiles Moore of a plea of Trespass upon the case &c And Whereupon the said Shiles by Josiah Polk his Attorney complains that whereas the said John on the eighteenth day of December Anno Dom. MDCCLXI at the county afsd. was Indebt -ed unto the said Shiles in the sum of thirty two pounds seven shillings and four pence Current money of Maryland for the articles in the account hereto annexed mentioned and so thereof Indebted being the said John in Consideration thereof afterwards to wit the day and year afsd. at the county afsd. upon himself did assume and to the said Shiles then and there faith -fully promised that he the said John when he should be thereto afterwards required the sum of money afsd. to the afsd. shiles he would faithfully pay and Content Nevertheless the said John his promise and assumption afsd. in form afsd. made not regarding the sum of money afsd. To the afsd. Shiles he hath not paid nor him for the same in any sort Contented but that to do altogether hath refused and still doth refuse altho the same to do afterwards to wit the day and year afsd at the county afsd. and often since that Time by the said Shiles required to the damage of the said Shiles sixty pounds Current Money of Maryland and thereof he brings Suit &c pledges &c J Doe & R Roe 1761 |
