March Court 1763 221 Somst To wit I doe hereby certify that on the Twenty Eighth day of December in the Year of our Lord seven -teen hundred Sixty & Two Came before me the subscriber the within named Thomas Holbrook & was Quallified as deputy comasary for the county afd Witness Ths Jones
Somerset County To wit
Princes Ann Town the third Tuesday of March Anno Dom. 1763 to Answer unto Michael Thorp of a plea of trespass upon the Case &c. And the Same day is given to the afd. Michael here &c. Att which day here Came the afd. Michael Thorp by Saml. Wilson his Attorney and the Sheriff to witt Ephraim Wilson now here Returned that he had taken the afd. John Rickets whose body here at this day he had Ready to Answer the afd. Michael Thorp of the afd. plea as to him it was Commanded And hereupon the Said Michael Thorp Complained Against the afd. John Rickets in the plea afd. in form following Somerset fst John Records Late of Somerset County Planter was Attached to Answer unto Michael Thorp of a plea of trespass upon the Case and So forth And Whereupon the Said Michael by Samuel Wilson his Attorney Complains that whereas the Said John Records on the Seventh day of Febry Anno Dom. MDCCLXii at the County afd. was Indebted to the Said Michael in the Sum of Twelve pounds Eighteen Shillings and ten pence Current Money of Maryland for the Articles and things in the Account hereto Annexed Mentioned and Specified and So thereof indebted being the Said John Records in Consideration thereof Afterwards to wit the Same day and Year afd. at the County afd. upon himself did Assume and then and there faithfully Promise that he the Said John the Sum of Money afd. when he Should be thereto Afterwards Required would well and truly pay and Content and altho the Said John hath Since paid unto the Said Michael the Sum of three pounds thirteen Shillings Curt Money afd. part of the afd. Sum of Twelve pounds Eighteen Shillings and ten pence Curt Money afd. Yet as to Nine pounds five Shillings and ten pence Current Money afd. Residue of the afd. Sum of Twelve Pounds Eighteen Shillings and ten pence Current Money afd. the Said John Records his promise and Assumption afd. in form afd. made Little Regarding but fraudulently intending the Said Michael in that part Craftily and Subtilly to deceive and defraud the Sum of Money afd. Residue afd. unto the Said Michael hath not paid or him for the Same in Any Sort Contented Altho the Same to do the Said John afterwards to wit the Same day and Year afd. and often Since at the County afd. was Required but the Same to him to pay hitherto altogether hath Refused and Still doth Refuse and Unjustly deny Whereupon the Said Michael Says he is the Worse and hath Damage to the Value of Twenty Pounds and therefore he brings Suit &c. Pledges of Pros. J. Doe & R. Roe
Against John Rickets is Just and true and that he never Received Any More Satisfaction for the Same then the above Credit Ephm. King Whereupon |
