June Court 1760 21 Thereto afterwards required Nevertheless ye said Ezekiell altho often required ye afd. sum of fifteen pounds Current money afd. to ye said Mathew he hath not same to him to render hitherto hat gainsayed & still doth gainsay to ye damage of ye. said Mathew thirty pounds Current money of Maryland & whereof he brings suit &c. Pledges &c. J. Doe & Ri. Roe Special Bail to ye. Action afd. thereupon a certain Purkin Venables of Somerset County Planter Present here in Court in his Proper person undertook for ye. said Ezekll. Humprhis that if it should happen that judgment in ye. plea afd. should be rendered for ye. said mathew against ye. afd. Ezekiell or that he the said Ezekiell should be therein Convict that then A Copy of ye foregoing declaration was made & sent to be served on ye Deft. in order for Speedy Tryall Att which day here Came ye. afd. Mathew Cannon by Josiah Polk his Atty & ye. sherriffe to wit John Dennis gent. now here returned that he had taken ye afd. Ezekll. Humphris whose Body here at this day he had ready to Answer ye. afd. Mathew Cannon of ye afd. Plea as to him it was Commanded And further ye same sheriffe returned that he had served ye afd. Ezekll. Humprhis with A copy of ye. foregoing Declaration According to Act of Assembly in such Case provided &c. Whereupon ye. said Ezekll. Humphris at ye. Prayer of ye. afd. Mathew Cannon is adjudged to give Special Bail to ye. Action afd. Thereupon a Certain Purkin Venables of Somerset County Planter Present here in Court in his Proper person undertook for ye said Ezekiell Humphris that if it should happen that judgment in ye. plea afd. should be rendered for ye. said Mathew afd. ye afd. Ezekiell or that he ye said Ezekiell should be therein Convict that then he the said Ezekiell should pay and satisfie unto ye. afd. Mathew ye. judgement of ye. Court thereupon or render his Body in Execution of such judgment to ye. Prison of ye sherriffe of ye. County afd. in satisfaction thereof or that he ye. said Purkin Venables will do ye. same for him &c. And ye. afd. Ezekiell Humphris by William Hayward his Attry Comes & Defends ye. force & Injury when &c. And prays Leave thereof to Imparle here untill next Court to be held at Princes Ann Town ye. third Tuesday of June then next following & he hath it & ye. same day is given to ye. afd. Mathew here also &c. Att which day here Came as well ye. afd. Mathew as ye. afd. Ezekll by their attys. afd. and hereupon ye. said Ezekll. as before Defends ye. force and Injury when &c. And saith that he Cannot deny ye. Action afd. of ye. afd. Mathew nor but that ye. writing obligatory afd. is ye. Deed of him ye. said Ezekll. nor but that he owes ye. afd. Mathew ye. afd. sum of fifteen pounds Current money I manner & form as ye. afd. Mathew above against him hath Decalred Therefore it is Considered that ye. afd. Mathew Cannon recover against ye. afd. Ezekiell Humphris his Debt afd. and his Damages by Occasion of ye Detention of that same Debt to 232 1/2 Pounds of Tobacco to ye. same Mathew of his Assent by ye. Court here adjudged & the afd. Ezekiell in Mercy &c |
