March Court 1763 219 Got a compass and had reversed the first Course of the afsd and Measured the distance and that they Intended to settle a bounder at the End of the distance and in the Course acordingly this deponant went Over To a Hamock in the marsh where John Horsey marked a white oake taking His Ax in his hand & desired the company To take Notice he marked that tree for a bounder of Cow Quarter whether it was one or not and further Saith not By Vertue of a Commission To us directed bearing date the 21st Day of March 1761 by the Justices of Somerset County Court Pursuant To act of assembly we the subscribers being Sworn according to the directions of that act as appears by the Indorsment Haveing Given due Notice as the Law Requiers in such Cases went on the Spott Mentioned in these depo -sitions & their did take their Oaths on the holy Evangelist of Almighty God to the truth of what is before mentioned this 25th Day of Aprill one thousand Seven hundred Sixty and one Given under our hands and Seals John Williams {Seal} James Gunby {Seal}
County Court of Somerset To be held at princess Ann Town the third tuesday of March Anno Dom. one thousand Seven hundred and Sixty three to answer unto William Allen & Littleton Dennis of a plea of trespass upon the Case &c & the same day is given to the afd William & Littleton here Att which day here Came the afd William & Littleton by Josiah Polk their Attorney & the sheriff to wit Ephraim Wilson now here returned that he had taken the afd Isaac Dashiell Whose body here at this day he had ready to answer the afsd William Allen & Littleton Dennis of the afd plea as to him it was commanded &c And hereupon the afd William & Littleton complained against the afd Isaac Dasheill in the plea afd in form following Somerset To wit Isaac Dasheill Late of Somerset County planter was attached to answer unto William Allen & Littleton Dennis of a plea of trespass upon the case &c And Whereupon the said William and Littleton by Josiah Polk their Attorney complain that whereas the said Isaac on the third day of Au -gust Anno Dom. MDCCLXII at Somerset County afsd was Indebted unto the said William and Littleton in the sum of twenty one pounds Eight shillings & Seven pence farthing Current Money of Maryland for the articles in the account hereto annexed mentioned and So thereof Indebted being the said the said Isaac in consideration there of afterwards to wit the day and Year afd at the county afd upon him -self did assume and to the said William and Littleton then and there faithfully promise that he the said Isaac when he should be thereto afterwards required the sum of Money afd To the afd William and Little -ton he would faithfully pay and Content Nevertheless the said Isaac his promise and assumption afd in form afd made not regarding the sum of Money afd To the afd William and Littleton he hath not paid nor them for the same in any Sort Contented but that to do altogether hath refused and still doth refuse altho the same to do afterwards to wit the day and Year afd at the county afsd and often since that Time by the said William & Littleton required to the damage of the said William and Littleton one hundred pounds Current Money of Maryland and thereof they Bring Suit &c pledges &c J Doe & R Roe
