three or Two of You all Such Evidences as shall be to You or any three or two of You Nominated by the said
Complainant or Deft & that You or any three or two of You Examine them upon their Corporal Oaths to be by
you or any three or two of You administred on the holy Evangelist of Almighty God in the presence of the
Complainant or Deft if any Touching the Truth or Remembrance of their Knowledge or any thing that
May relate To the cause afsd & that reducing the Several Depositions into writin you Send the same with
this our Commission under your or any three or Two of Your Hands and Seals to us To our County court
of Somerset with all Convenient Speed Wittness Isaac Handy Esqr Cheif Justice of our Said Court the 18th
Day of June in the 12th Year of our Dominion &c Anno Dom. 1762
And Now To witt at a court of his Lordship held at princess Ann Town the third tuesday of March
                                                        Anno Dom. 1763
being the fifteenth day of the same Month ^ before the Justices thereof Came Levin Wilson and Planner
Williams Two of the Gentlemen Nominated in the foregoing Commission & Returned the same En
-dorsed in manner following with the severall Depositions thereto annexed
5th of October 1762 Then was Messrs Levin Wilson and Planner Williams Quallified as commissio
-ners on the within Lands agreeable To an act of assembly in Such case made and provided

                                         We the Subscribers do hereby Certify that the depositions hereunto annexed
was duly taken agreeable To the within Commission To us directed as witness our hands & Seals

                                    (For Capt William Waters)
The deposition of Edward Waters aged Fifty Five Years or thereabouts being Sworn on the Holy Evangels
of Almighty God Deposeth and Saith that he hath been acquainted with the Head of Halls Creek about for
-ty years and upwards and that there was a leading Channell above a Cedar post now Set up marked with
notiches that a common Tide Ebb'd and Flowed in and that there was a naked pond above the post which
the Tide flow'd into Except at a nipp Tide and that there was a Crotch Fence about Eight Steps below
the post To prevent Cattle from Getting over and that the old main Road went a cross the head of Halls
Creek about four Yards above the said post and this Deponant Further Says that where the post now
Stands was near the Head of Halls Creek also this deponant Says that his Cousin William Waters
Told him that the head of Halls Creek was about Fifty Yards above where the said post now stands
where a marked Oak Stood which was a bounder of a Tract of Land Called Conveniency and that the

said William Waters was owner of ^ Tract of Land called Conveniency and further this deponant saith
not Sworn To the day & year aforesaid                                               Edward Waters
The deposition of Alce Miles aged Sixty Seven Years or thereabouts being first Sworn on the holy Evan
-gels of Almighty God Deposeth & Saith that the Head of Hall's Creek went up To where the old
Main Road Crossed which was Twenty Yards above the marked post now set up and that a common
Tide then Ebb'd and Flow'd above said Main Road and that Riding the Main Road across the Head of
Halls Creek it would Take her horse up To his belly at High Water & further this deponant Saith
not Sworn to the day and year afsd                           Alce Miles
The deposition of Capt William Turpon aged Fifty Seven Years or thereabouts being first Sworn
on the Holy Evangels of Almighty God Deposeth and Saith that he hath been acquainted with
the Head of Halls Creek from his Youth upwards and frequently used To drive Cattle over the same
and that where the Old Main Road Crossed a little above where now stands a post and that a
Common Tide then Ebb'd and Flow'd a small distance above the said Road and this deponant
further Saith that when it was high Water he was afraid To Ride the Main Road So used to
goe Round the head of Halls Creek but as for a gut or Creek Coming up to the main Road doth
Not Remember and further Saith not Sworn to the day & Year afd
