March Court 1763 217 The Deposition of Joseph Cotman aged forty Eight Years or thereabouts being first Sworn on the holy Evangels of Almighty God deposeth and Saith that he has been acquainted with the head of Halls Creek about thirty years and that he used to be Sent with Cattle To the Marshes & that when he used to Ride the old main Road when the Tide was high went Round the head of Halls Creek through the woods and that where the post Now Stands was called by the people the head of Hall's Creek and that the Tide then Ebb'd and Flow'd above the main Road To the Best of his Knowledge & further Saith not Sworn the day & Year aforesaid Joseph Cotman The Deposition of Nathaniel Roach aged Forty Seven Years or thereabouts being First Sworn on the Holy Evangels of Almighty God deposeth and Saith that he hath been acquainted with the head of Halls Creek from his youth and that where the main Road crossed was always deemed to be the head of Halls Creek and this Deponant further Saith that his Father John Trehearn told him where the main road crossed a little above was Called the Head of Halls Creek and this deponant Says that where the post now Stands was allways Called the Head of the aforesd. Creek to the best of His Knowledge & further Saith not not Sworn the day & year aforesd. Nat. Roach The deposition of James Trehearn aged forty seven years or thereabouts being first sworn on the Holy Evangels of Almighty God Deposeth and Saith that about thirty years past that he was a riding along with his father and coming a cross a small creek or Gut asked his father What place that was and his Father John Trehearn told him that it was the head of Halls Creek & this deponant Then saw the Tide a flowing over the old Road which was about Six Yards above A marked Cedar post now Set up and this deponant Further Saith that it was no more than a common Tide that he saw flow Over the Road abovementioned and further this deponant Saith not sworn the day & Year aforesaid Jas Trehearn The deposition of Samuel Tull aged Fifty Seven Years or thereabouts Being first Sworn on the Holy Evangels of Almighty God deposeth & Saith that he was born at or near the head of Tulls Creek & brought up there and has been acquainted with the Head thereof untill the Year of our Lord one thousand Seven hundred and Twenty Seven and Saith that within Six yards where now stands a Cedar post marked with sixteen Notches is the head of Swanny Creek but now called Tulls Creek and further this deponant Saith that an overflowing Tide flow'd over the whole marsh and that forty yards or thereabouts below the post above mentioned the creek was Full of Tussix and further this deponant Saith not taken this 8th Day of November in the Year of our Lord one thousand Seven hundred & Sixty Two Samuel Tull The Deposition of James Trehearn aged Forty Seven Years or thereabouts being first Sworn on the holy Evangels of Almighty God deposeth & Saith that he has been acquainted with the head of Tulls Creek about Thirty two years & that where now Stands a marked Cedar Post within Four yards above or below the said post is the head of the afd Creek and and that the Creek had Tussix in it below the post as mentioned in Samuel Tull's deposition and this Deponant Further Saith That a Punt or Canew could Come no higher Up than forty or fifty yards below the said Post To the Best of his knowledge and further this deponant Saith not taken the day and Year afd Jas Trehearn The Deposition of Nathaniel Roach aged Forty Six Years or thereabouts being first Sworn on the ho up the head of -ly Evangels of Almighty God Deposeth & Saith that he was born brought ^ and lived near ^ Tulls Creek and that where now stands a marked Cedar post is the head of the aforesaid Creek or thereabouts and that Edmund Cullen who lived Near the head of the aforesaid Creek told this deponant that where the afd post Stands was the head of the Creek aforesaid and that there was tussix in the Creek forty or fifty yard below the said post and that he this deponant used to goe over on the said Tussix at Low water of half Tide and at high water used to goe over where the post Now Stands to the best of his knowledge and further this deponant saith not taken |
