there never was in the Remembrance of this deponant any appearance of a Creek or Gut near
the said Road and further this deponant Saith not as witness my Hand the day & Year
aforesaid                                                           Lazarus Maddux
The deposition of Boaz Walston aged Sixty Eight Years or thereabouts being First Sworn on
the Holy Evangels of Almighty God Deposeth and Saith that he has been acquainted with
the Head of Halls Creek upwards of Fifty Years and that he frequently passed by the same
and that the Road that was used To goe down the Neck went near the said Creek and that
fifty Years agoe & Ever Since he never Saw any Creek or Sign of a Gutt near the said Road and
that he always observed that about the said Road there was a low flatt wett place of Marsh on

which the freshes would Lie upon & that the water on the said place was Sometimes ^ and Some
-times Lower but that the same Never appeared Like a Creek or Gutt & further this depo
-nant Saith not as witness my hand this 5th Day of April Anno Dom. one thousand Seven
hundred and Sixty Two                                                 Boaz Walston
The deposition of Catherine Ford aged Sixty nine Years and upwards being First Sworn on the
Holy Evangels of Almighty God deposeth and Saith that from her Youth she has lived in the
Neighbourhood near Halls Creek and that she has been Ever since well acquainted with
The same Creek and the head thereof and that she has often about Fifty Years agoe and up
-wards went from Mr Hall's who then lived on the West Side of the Creek to Mr Waters's Who lived
on the East Side of the Creek and the Way was over a small Gutt which then a person could
Stride over and that the place where they then went over was the place Mentioned in the deposi
                                                   that
-tions of Ben and Mary Sharpe and ^ the path went through A pine thicket and the same
place was then always Called the Hed of Halls Creek and that the riding along the road
was then always Called Riding Round the head of Halls Creek and that Since her acquain
-tance with the same place the said Creek or Gut has grown considerably wider and further

The deposition of Esther Tull aged Seventy Four Years or thereabouts being First Sworn on
the Holy Evangels of Almighty God deposeth & Saith that she has been acquainted with
Hall's Creek and the head thereof upwards of Fifty Years that She has often passed over
the place mentioned in the deposition of Catherine Ford and She does not now remember
the wedth and that Ever Since her acquaintance with the same the going the Road was
called going Round the Head of the Head of the Creek & that there was there a low Flatt place
and a Hill as mentioned in the deposition of Samuel Tull and this deponant further saith
that she has often Seen the same place dry and there was not then any drain or Gut or any
appearance of a Gut or Creek through the same and further this deponant Saith not as
witness my hand the day and Year aforesaid                     Esther Tull

Furnace of Somerset County Gentlemen Greeting know ye that we have appointed you Or any three or
Two of You to be our commissioners To Examine Evidences on behalf of a certain William Waters Senr of
Somerset County in Relation To the Bounds of a Tract of Land called Waters's River or the bound of any o
-ther Land on which the bound of the afsd Land may depend we therefore require You or any three or
Two of You at Some Time & place as to you or any three or Two of you shall Seem Convenient you meet on the afd
Land Called Waters River or any other Lands on which the bounds of the afsd Land may depend you first
haveing Taken Your Oaths on the Holy Evangelist of Almighty God & there Cause To Come before you or any
