Middle of the Slough and that both above and below the said Road on the said Hill pine Saplins
grew and that Since that Time the said Saplins have gone to decay and that the said Hill hath
Since became Marsh and the pines have Since decayed and that he hath often observed that the wa
-ter in the said Slough was Sometimes Higher & Sometimes Lower and that there never was in
his Remembrance any appearance of a creek or Gut through the said Slow or Low Place and that
Ever Since his Remembrance the Creek and Gutt up Hall's Creek was no higher up than the same
is at present & that he always understood that Mr Richard Waters who held Lands on Halls Creek and
was bounded by the head thereof Settled a Post marked with Notches at the head of the Creek which
Stands about one hundred and Seventeen Strides above the place mentioned in Ben Sharpes
and Mary Sharpes deposition and that Ever Since his Remembrance there was no Sign of a
gut Further than about Seventy Five Strides above the said Bounder and this deponent further
Saith that Since his Remembrance the Salts have gained about the head of the said Creek
upon the Land that the Woods about the same have decayed and Marsh got upon the same
and that this deponant further Saith that when the water was empty in the said Low place
he never observed any drain or branch in the same and further this deponant Saith Not as
witness my hand this fifth Day of Aprill Anno Dom. one thousand Seven hundred & Sixty
Two                                                              Samuel Tull
The Deposition of Joshua Tull aged fifty one Years and upwards being first Sworn on the Holy Evangels
of Almighty God Deposeth and saith that he always lived within a mile & Half of the head of Hall's
Creek and ever Since his Remembrance he has been acquainted with the same and that the Road as
mentioned in the deposition of Samuel Tull and that the Road went through a Low place which at
Spring Tides and Great Freshes would be full of Water up to a Beasts Belly and that he hath of
-ten observed in dry Times that the same place was dry and that then there never was any Sign
through the same of a Creek or Gutt or any appearance of the same or as this deponant rode a
-long the same there was none that he Could See and further Saith not as witness my hand
the day & Year aforesaid                                                         Joshua Tull
The deposition of Richard Hall aged Sixty Seven Years and upwards being Sworn on the Holy

Evangels of Almighty God deposeth and Saith that ^ was raised & always Lived within a
mile of Halls Creek & the head thereof & haith been always well acquainted with the same
and that he hath often Rode and observed the Road Mentioned in the deposition of Samuel
Tull & that he always understood the Riding of the said Road was riding Round the head of
Halls Creek and the said Road went through a kind of Flatt place or Slough and that he never
Saw or observed any thing Like a Creek or Gut up to the said Slough or near the same and
that he is perfectly acquainted up and along the said Creek and that Ever Since his Remem
-brance the Salts & marsh have Gained considerably on the Land and as much or more than
upon any Lands he is acquainted with and this deponant Further Saith that Since he
was acquainted with the said Road and the place thereabouts the woods was thirty or forty
yards Lower down than at present & that the Marsh has gained that much Since and further
Saith not as witness My hand the day and Year aforesaid              Richard Hall
The deposition of Lazarus Maddux aged Seventy Two Years and upwards being First Sworn on the
holy Evangels of Almighty God deposeth & Saith that he hath been well acquainted with the place
about the head of Halls Creek for fifty Years and that he hath often Rode and observed the Road
as mentioned in the deposition of Samuel Tull and that there always was there a low place of Ground
like unto a pond of Each Side of the said Road that the water which Stood in the same pond was Sometimes
higher and Sometimes Lower that the water Stood upon it according To the fresh that was at that
