March Court 1763 210 him the said Samuel then & there did To the great damage of the said Samuel & against the peace of his Lordship the Right Honle the Lord propry that now is his good rule & Government & So forth Thereupon it is commanded the sheriff of Somerset County that he should take the afd William Baily if he should be found in his Bailywick and him should Safe keep So that he might have his body before his Lordships Justices of the next Court To be held at princess Ann Town the third tuesday of March then next following to answer unto his said Lordship of & concerning the Inditctment afd Att which day here came as well George Hayward Gent his Lordships attorney who for his said the Said William Lordship in this part prosecuteth as the afd William Bailey in his proper person and ^ had a hearing of the Indictment afd saith that he will not contend with his Lordship but for the saving costs Labour & Expences about the premises submits himself at Fine with his said Lordship & puts himself upon favour of the court &c Whereupon all & Singular the premises being Seen & by the court fully unders- William Baily tood it is considered that the afd ^ for the offence afd be taken &c which said William Present here in Curt Money of Maryland Court as afd is fined for the premises & offence afd the sum of one shilling ^ which he paid To the sheriff for the use of his Lordship &c
of our Lord one thousand Seven hundred Sixty & one at the parish afd in the county afd did com -mit Fornication with a certain Priscilla Mardike & a Bastard child on the body of the said Pris -cilla then & there did beget To the High Displeasure of Almighty God to the Evil Example of all others in such Case offending against the peace of his Lordship the said Lord propry that now is his good Rule & Government & against the form of the act of assembly in such case made & provided &c Thereupon it is Commanded the sheriff of Somerset County that he Should take the afd Jonathan Cluff if he should be found in his bailywick & him should Safe keep So that he might have his body Lordships at before His ^ Justices then next following to answer unto his said Lordship of & Concerning the Indictment afd Att which day here came the afd Jonathan Cluff in his proper person & had a hearing of the Indictment afd Saith that he is not thereof Guilty & puts himself upon the country & Geo. Hayward Gent his Lordships Attorney who for his said Lordship in this part prosecuteth likewise Whereupon it is commanded the sheriff of Somerset County that he should cause to come before his at Lordships Justices ^ then next following Twelve &c by whom &c and who &c To Recognize &c because &c Att which day here came as well George Hayward Gent who for his Said Lordship in this part prosecuteth as the afd Jonathan Cluff by Wm. Hayward his Attorney & the sheriff To Witt Ephraim Wilson returned the afd writt of Venire facias & the names of the Jurors in all things Served & Execu -ted & the Jurors of that Jury thereof Impannelled being called to witt Wm Skirvin John Piper Robt Elzey Wm Turpin Elias White Aaron Sterling Thomas Handy John Anderson Joshua Hitch Jonathan Tull Nehemiah Bosman & William Roberts Came who to say the truth of the premises afd being Elected tryed & Sworn upon their Oath Say that the afd Jonathan Cluff is guilty of the premises afd in the Indictment afd upon him imposed in manner and form as by the Indictment afd above against him Supposed whereupon all & Singular the premisses being Seen & by the court fully understood it is considered that the afd Jonathan Cluff for the offence afd in the Indictment afd mentioned |
