And thereupon at ye. Prayer of ye. Parties afd. day is to them here now given untill
the next Court to be held at Princes Ann Town ye. third Tuesday of August then next
following in ye. state that now saving to ye. Parties afd.
Att which day here came ye. Parties afd. by their Attys. afd. and hereupon ye.
said Charles Brown Complained afd. ye. afd. William Smith in ye. afd. plea afd. in
form following
                                                                              Gent.
Somerset to wit William Smith Late of Somerset County ^ Mariner was attached to
answer unto unto Charles Brown Executor of ye. Last Will & Testament of John
Nutter Deceased of a plea of Trespass upon ye. Case & so forth
And Whereupon ye. said Charles by William Hayward his attry. Complains that
Whereas ye. said William Smith on ye.       day of       in ye year of our lord God one
thousand seventeen hundred &            at ye. County afd. was attached Indebted unto ye.
said John in his Lifetime in ye. sum of Forty pounds Current money of ye. Island
of Jamaica which is of ye. value of fifty pounds Current money of Maryland for
so much money of the Island of Jamaica afd. before that time by ye afd. William
Smith to ye. use of ye. of ye said John had & received and so therein Indebted being ye.
said William Smith in Consideration thereof afterward to wit, ye same day and
year afd. at ye. County afd. Assumed upon himself & to ye afd. John in his Life time
then and there faithfully promised that he ye. afd. William Smith ye. afd. Forty
Pounds Current money of ye. Island of Jamaica afd. which is of ye. value afd. to ye.
afd. John when he should be thereto afterward required well & faithfully would pay
and Content Nevertheless ye. said William Smith not regarding his promise
and Assumption afd. in form afd. made but Intending to deceive defraud ye. sum
of forty pounds Current money of ye. Island of Jamaica afd. or ye. afd. sum of
fifty pounds Current money of Maryland which is ye. value thereof unto ye. afd.
John in his Life time or unto ye. afd. Charles since ye. Death of ye. said John hath
Not paid or in any sort Contented but the same to ye. said John in his Life
time to pay ye. said William Smith altogether refused and ye. same to ye. said
Charles since ye. Death of ye. said John ye. said William Smith hath not paid
but that to do hitherto hath refused and still doth refuse and unjustly
detain to ye Manifest delay of ye. Execution of ye. Last Will & Testament of ye. afd.
John Whereupon ye. said Charles says he is worse & hath Damage to ye. the value
of Eighty pounds Current Money of Maryland & thereof he brings suit & so forth & brings
here into Court ye. Letters Testamentry afd. of ye. afd. John Whereby &c
                          Pledges &c. J: Doe & R. Roe
And ye. afd. William Smith by Samuel Wilson his Atty. Comes and Defends ye. force and Injury
When &c. And prays Leave thereto Imparle here untill ye. next Court to be held at Princes
Ann Town ye. third Tuesday of November then next following & he that it & ye. same
day is given to ye. afd. Charles here also &c
Att Which day here came as well ye. afd. Charles as ye. afd. William by their Attys afd. &
hereupon ye. said William prays further Leave thereof to Imparle here untill next
Court to be held at Princes Ann Town ye. third Tuesday of March then next following
& he hath it & ye. same day is given to ye. afd. Charles here also &c
