June Court 1760 20 The Premisses in that Part sustained ye. same John saith & acknowledgeth hath that the afd. Benjamin ^ sustained Damages by Occasion of ye. Premisses beyond his Costs and Charges by him about his suit in that part apposed to Eighteen pounds seventeen shillings & four pence half penny Current money of Maryland and not more & because ye. afd. Benjamin Denys not this but the same Allegation grants to be true prays Judgment for those Damages above acknowledged together with his Costs and Charges afd. to him to be Adjudged &c. by Therefore ^ Consent of ye. Parties afd. it is Considered that the afd. Benjamin Fransway recover against ye. afd. John Cox his Damages afd. to the afd. Eighteen pounds seventeen shillings & fourth pence half penny Curt. money by ye. same John in form afd. Acknowledged as also 369 Pounds of Tobacco for his Costs & Charges afd. to ye. same Benjamin at his request by ye. Court now here of the Assent of ye. parties afd. adjudged which certain Damages in ye. whole amount to Eighteen pounds seventeen shillings & four pence half penny Curt. money & Pounds of Tobacco & ye. afd. John in Mercy &c.
County Court of Somerset to be held at Princes Ann Town ye. third Tuesday of June Anno Dom. one thousand seven hundred & fifty Nine to answer unto Chas. Brown admr. of all & singular ye. goods & Chattles rights & Credits which were of John Nutter Deceased at ye. time of his Death of a plea of Trespass upon ye. Case &c. And ye. same day is given to ye. Chs. Brown here And so forth Att Which day here Came ye. afd. Chs. Brown adr. of Wm. Nutter by William Hayward his Attry & ye sherriffe to witt John Dennis Gent. now here returned that he had taken ye. afd. afd. William Whose Body here at this day he had ready to answer ye ^ Charles of ye. afd. Plea As to him it was Commanded Whereupon ye. said William Smith at ye. Prayer of ye. afd. Charles Brown is adjudged to give Special Bail to ye. Action afd. Thereupon a certain Benjamin Langford of Somerset County Planter Present here in Court in his proper person undertook for ye. said William Smith that if it should happen that Judgment in ye. plea afd. should against be rendered for ye. said Charles ^ ye. afd. William or that he the said William should be therein Convict that then he the said William should pay & satisfie unto the afd. Charles ye. Judgment of ye.Court thereupon or render his Body in Execution of such judgment to ye. Prison of ye. sherriffe of ye. County afd. in satisfaction thereof or that he the said Benjamin will do ye. same for him &c. Whereupon ye said William Smith puts in his place Samuel Wilson gent. Attorney at Law afd ye. afd.
