	@	Command was given unto the sheriff of Somerset County that he should take Moses
WH	Moses Carter	Carter Late of Somerset County planter otherwise Called Moses Carter if he should be

found in his Bailywick and him should Safe keep so that he might Have his body before the Justices
of his Lordships County Court of Somerset To be held at princess Ann Town the third tuesday of June
Anno Dom. one thousand Seven hundred & Sixty Two To answer unto Benjamin Stuart of a plea that he ren
-der unto him the sum of Twenty Four pounds four shillings Current Money of Virginia of the Value of
thirty pounds current Money which from him he unjustly detains &^c and the same day is given to the af^d Benja
-min here Also &^c            Att which day here Came the af^d Benjamin Stuart by Josiah Polk his
Attorney and the sheriff to witt Ephraim Wilson now here returned that he had taken the af^d Moses Carter whose
body here at this day he had ready to answer the af^d Benjamin of the af^d plea as to him it was commanded &^c
Whereupon at the prayer of the af^d Benjamin Stuart the af^d Moses Carter is adjudged to give special bail to the action af^d
Thereupon a certain Richard Waller present here in Court in his proper person undertook for the said Moses Carter
and assumed upon himself that if it should happen that Judgment in the plea af^d. should be rendred for the
said Benjamin Stuart against the af^d Moses Carter or that he the said Moses should be therein convict that then
the said Moses should pay and Satisfy unto the af^d Benjamin the Judgement of the court thereupon or render
his body in Execution of Such Judgement To the prison of the sheriff of the county af^d in satisfaction thereof
or that he the said Richard Waller will do the same form him &^c            And Hereupon the af^d Moses Car
-ter puts in his place William Hayward Gen^t attorney at Law against the af^d Benjamin Stuart of the af^d plea
And Hereupon at the prayer of the parties af^d Day is to them now here given untill Next Court To be held at
princess Ann Town the third tuesday of August then next following in the state that now saveing to the parties af^d
Att which day here came the parties af^d by their Attorneys af^d & hereupon the af^d Benjamin Stuart declared against
the af^d Moses Carter in the plea af^d in Form following       Somerset To wit Moses Carter Late of Somerset county
planter otherwise Called Moses Carter was Summoned To answer unto Benjamin Stuart of a plea that he render
him the Sum of twenty four pounds four shillings Current Money of Virginia of the Value of thirty pounds
current Money of Maryland which from him he unjustly detains &^c And Whereupon the said Benjamin
by Josiah Polk his Attorney Says that whereas the said Moses on the sixteenth day of June Anno Dom.
MDCCLX at Somerset County af^d by his certain writing obligatory sealed with the Seal of the said Moses
here in Court Shews whose date is the day and Year af^d Granted himself to be held and firmly bound
unto the said Benjamin in the said Sum of Twenty Four pounds four Shillings Current Money of Virgi
-nia of the Value of thirty pounds Current Money of Maryland to be paid To the said Benjamin when
he should be thereto afterwards Required Nevertheless the said Moses altho often required the af^d Sum of
Twenty Four pounds four shillings Current Money of Virginia of the Value of thirty pounds Current Money
of Maryland to the af^d Benjamin he hath not Rendred but the same to him to Render hitherto hath
gainsayed and Still doth gainsay and unjustly detain to the Damage of the said Benjamin Fifty pounds
Current Money of Maryland and thereof he brings Suit &^c    pledges &^c J Doe R Roe
And hereupon the af^d Moses Carter by his Attorney af^d Comes and Defends the force and injury when &^c and
prays leave thereof to Imparle Here untill Next Court To be held at princess Ann Town the third tuesday of November
