pounds ten shillings and six pence Curt Money and not more and because the afd Moses Allen denies
not this but the same Allegation grants to be true he prays Judgement for these Damages above acknow
-ledged together with his Costs and charges to him to be adjudged &c            Therefore by consent of
the parties afd It is considered that the afd Moses Allen Recover against the afd John Records his
damages afd to the afd Five pounds ten Shillings and Six pence Curt Money by the afd John in
233    form afd acknowledged as also                                                         pounds of Tobacco for
his Costs and charges to the same Moses at his request by the court now here of the assent of the parties
afd adjudged which certain Damages in the whole amount To five pounds Ten shillings & Six
pence Curt Money and                                                                pounds of Tobacco & the afd John
in Mercy &c

@    Command was given unto the sheriff of Somerset County that he should take Moses
WH    Moses Carter    Carter Late of Somerset County planter otherwise Called Moses Carter if he should be
found in his Bailywick and him should Safe keep so that he might Have his body before the Justices
of his Lordships County Court of Somerset To be held at princess Ann Town the third tuesday of June
Anno Dom. one thousand Seven hundred & Sixty Two To answer unto Benjamin Stuart of a plea that he ren
-der unto him the sum of Twenty Four pounds four shillings Current Money of Virginia of the Value of
thirty pounds current Money which from him he unjustly detains &c and the same day is given to the afd Benja
-min here Also &c            Att which day here Came the afd Benjamin Stuart by Josiah Polk his
Attorney and the sheriff to witt Ephraim Wilson now here returned that he had taken the afd Moses Carter whose
body here at this day he had ready to answer the afd Benjamin of the afd plea as to him it was commanded &c
Whereupon at the prayer of the afd Benjamin Stuart the afd Moses Carter is adjudged to give special bail to the action afd
Thereupon a certain Richard Waller present here in Court in his proper person undertook for the said Moses Carter
and assumed upon himself that if it should happen that Judgment in the plea afd. should be rendred for the
said Benjamin Stuart against the afd Moses Carter or that he the said Moses should be therein convict that then
the said Moses should pay and Satisfy unto the afd Benjamin the Judgement of the court thereupon or render
his body in Execution of Such Judgement To the prison of the sheriff of the county afd in satisfaction thereof
or that he the said Richard Waller will do the same form him &c            And Hereupon the afd Moses Car
-ter puts in his place William Hayward Gent attorney at Law against the afd Benjamin Stuart of the afd plea
And Hereupon at the prayer of the parties afd Day is to them now here given untill Next Court To be held at
princess Ann Town the third tuesday of August then next following in the state that now saveing to the parties afd
Att which day here came the parties afd by their Attorneys afd & hereupon the afd Benjamin Stuart declared against
the afd Moses Carter in the plea afd in Form following       Somerset To wit Moses Carter Late of Somerset county
planter otherwise Called Moses Carter was Summoned To answer unto Benjamin Stuart of a plea that he render
him the Sum of twenty four pounds four shillings Current Money of Virginia of the Value of thirty pounds
current Money of Maryland which from him he unjustly detains &c And Whereupon the said Benjamin
by Josiah Polk his Attorney Says that whereas the said Moses on the sixteenth day of June Anno Dom.
MDCCLX at Somerset County afd by his certain writing obligatory sealed with the Seal of the said Moses
here in Court Shews whose date is the day and Year afd Granted himself to be held and firmly bound
unto the said Benjamin in the said Sum of Twenty Four pounds four Shillings Current Money of Virgi
-nia of the Value of thirty pounds Current Money of Maryland to be paid To the said Benjamin when
he should be thereto afterwards Required Nevertheless the said Moses altho often required the afd Sum of
Twenty Four pounds four shillings Current Money of Virginia of the Value of thirty pounds Current Money
of Maryland to the afd Benjamin he hath not Rendred but the same to him to Render hitherto hath
gainsayed and Still doth gainsay and unjustly detain to the Damage of the said Benjamin Fifty pounds
Current Money of Maryland and thereof he brings Suit &c    pledges &c J Doe R Roe
And hereupon the afd Moses Carter by his Attorney afd Comes and Defends the force and injury when &c and
prays leave thereof to Imparle Here untill Next Court To be held at princess Ann Town the third tuesday of November
