WH    Benj: Fransway    Command was given to ye. sherriffe of Somerset County that

 vs    he should take John Cox Late of Somerset County Mariner

   if he should be found in your Bailywick & him safe keep so that
he might have his Body before ye. Justices of his Lordships County Court of Somerset to
be held at Princes Ann Town ye. third Tuesday of March to Anno Dom. one
thousand seven hundred & fifty Nine to Answer unto Benjamin Fransway
of a plea of Trespass upon ye Case &c.
   And ye. same day is given to ye. afd. Benjamin here &c
And hereupon ye. said Benjamin Complains against ye. afd. John in ye. plea
afd. in form following
Somerset fst John Cox Late of Somerset County Mariner was Attached
to answer unto Benjamin Fransway of a plea of Trespass upon ye. Case &c.
And Whereupon ye. said Benjamin by William Hayward his Atty Complains

that Whereas ye. said John Cox ^ XXI day of February Anno. Dom. MDCCLViii
at ye. County afd. was Indebted unto ye. said Benjamin in ye. sum of One hundred
And Eight pounds seven shillings & two pence Current money of Maryland for ye.
sundry Articles and things in ye. Account hereto annexed mentioned and so thereof

Chargeable being ye. said ^ in Consideration thereof afterwards to wit ye. same day &
year afd. at ye. County afd. upon himself Assumed and to the said Benjamin
then & there faithfully Promised that he ye said John ye. sum of Money afd. unto ye.
said Benjamin when he should be thereto afterwards required well and faithfully would
pay and Content Nevertheless ye. said John his promise & Assumption afd. in form afd.
made Nothing regarding but minding & fraudulently intending ye. said Benjamin
in that part Craftilly and Subtilly to deceive & Defraud the sum of money afd. unto ye.
said Benjamin hath not paid or him for ye. same in any sort Contented (Altho ye.
same to Doe &c. same John Afterwards to wit ye. same day & year afd. & often since at
ye. County afd. by ye. said Benjamin was required but ye. same to him to pay hitherto
Altogether hath refused & still doth refuse & unjustly Deny whereupon ye. said
Benjamin says he is Worse & hath Damage to ye. value of one hundred &
Twenty pounds Current money of Maryland & thereof he brings suit &c.
