November Court 1762 188 princess Ann Town the third tuesday of June Anno Dom. one thousand seven hundred and sixty two to answer James Mills & John Eden of a plea of trespass upon the case and so forth and the same day is given to the afd. Mills & Eden here also Att which day here came the afd. James Mills & John Eden by Josiah Polke their Attorney and the sheriff to wit Ephraim Wilson now here returned that he had taken the afd. Stephen Lank whose body here at this day he had ready to Answer the afd. Mills & Eden of the afd. plea as to him it was commanded And hereupon the said Stephen Lank puts in his place Samuel Wil -son Gent Attorney at Law against the afd. Mills & Eden of the afd. plea And hereupon at the prayer of the parties afd. Day is to them now here given until next court to be held at princess Ann Town the third tuesday of August then next following in the state that now saveing to the parties afd. Att which day here came the parties afd. by their Attorneys afd. and hereupon the said Mills & Eden complained against the afd. Stephen Lank in the plea afd. in form following Somerset to wit Stephen Lank late of somerset county planter was attached to answer unto James Mills & John Eden of a plea of trespass upon the case and so forth And Whereupon the said James and John by Josiah Polk their Attorney complains that whereas the said Stephen on the twenty sixth day of October Anno Dom. MDCCLXI at the county afd. was Indebted unto the said James & John in the sum of nine pounds six shillings & four pence farthing current money afd. for the articles in the account hereto annexed mentioned Indebted and so thereof ^ being the said Stephen in consideration thereof afterwards to wit the day and year afd. at the county afd. upon himself did assume and to the said James & John then and there faithfully promise that he the said Ste- -phen Lank when he should be thereto afterwards required the sum of money afd. to the afd. James & John he would faithfully pay and content Nevertheless the said Stephen his promise and assumption afd. in form afd. made not regarding the sum of money afd. to the afd. James & John he hath not paid or them for the same in any sort contented but that to do altogether hath refused and still doth refuse altho the same to do afterward to wit the day and year afd. at the county afd. and often since that time by the said James & John required to the damage of the said James & John twenty pound current money of Maryland and thereof they bring suit &c J Doe R Roe pledges of prosg
