November Court 1762 189 together with their costs and charges to them to be adjudged &c. Therefore by consent of the parties afd. it is considered that the afd. Mills & Eden Recover against the afd. Stephen Lank their damages afd. to the afd. six pound twelve shillings and ten pence farthing Curt Money by the afd. Stephen Land in form 116 afd. acknowledged as also pounds of Tobacco for his costs and charges afd. to the same Mills & Eden at their request by the court now here of the assent of the parties afd. adjudged which certain Damages in the whole amount to six pounds twelve shillings and ten pence farthing Curt Money and pounds of tobacco and the afd. Stephen in Mercy &c.
somerset to be held at princess Ann Town the third tuesday of June Anno Domini one thousand seven hundred and sixty two to answer unto Alexander Stuart of a plea of trespass upon the case and so forth and the same Day is given to the afd. Alexander here also &c And hereupon the afd. Alexander Stuart com plained against the afd. Isaac Roads in the plea afd. in form following Somerset to wit Isaac Roads Late of somerset county planter was attached to answer unto Alexander Stuart of a plea of trespass upon the case & so forth And Whereupon the said Alexander by Josiah Polke his Attorney complains that whereas the said Isaac on the fourteenth day of July Anno Dom. one thousand seven hundred and sixty one at the county afd. Did make his certain note in writing called a promissary Note with his proper Name and hand thereto subscribed bareing date the day and year afd. at the county afd. and that note to the said Alexander then and there did Deliver by which said note the said Isaac promised to pay to the said Alex ander Stuart or his Assigns the full and just sum of six pounds six shillings & five pence three farthings curren :cy by the twenty fifth day of December for Value Recd. by means whereof and by force of the statute in such case Lately made and provided the said Isaac Became chargeable to pay to the said Alexander the said sum in the said Note mentioned according to the tenor of that note and so thereof chargeable being the said Isaac on conside -ration thereof afterwards to wit the day and year afd. at the court afd. promised to pay to the said Alexander the said sum in the said Note mentioned according to the Tenor of that note Nevertheless the said Isaac his promise afd. in form afd. made not regarding the said sum in the said note mentioned according to the Tenor of that nore to the said Alexander hath not paid but that to do hitherto hath denyed and still doth de -ny alltho thereto afterwards to wit the day and year last afd. at the county afd. and often since that time by the said Alexander Required to the damage of the said Alexander fifteen pounds current money of Maryland and thereof he brings Suit &c. J Doe R Roe pledges of prosg A copy of the foregoing Declaration was made & sent to be served on the deft. in order for speedy tryal Att which day here came the afd. Alexander Stuart by his Attorney afd. and the sheriff to wit Ephraim Wilson she -riff of the county afd. now here returned that he had taken the afd. Isaac whose body here at this day he had ready to answer the afd. Alexander Stuart of the afd. plea as to him it was commanded Whereupon the said Isaac Roads at the prayer of the afd. Alexander Stuart is adjudged to give special Bail to the action afd. Thereupon a certain Matthew Dorman present here in court in his proper person undertook for the said Isaac Roads and assumed upon himself that if it should happen that judgement in the plea afd. should be rendred for the said Alexander against the afd. Isaac or that he the afd. Isaac should be therein convict that then he the said Isaac should pay and satisfy unto the afd. Alexander the Judgement of the court thereupon or render his body in Executi -on of such Judgement to the prison of the sheriff of somerset county in satisfaction thereof or that he the said Matthew Dorman will do the same for him &c And the afd. Isaac Roads By William Hayward his Attorney comes and Defends the force and Injury when &c. and prays leave thereof to Imparle here untill next court to be held at princess Ann Town the third tuesday of August then next following and he hath it and the same day is given to the afd. Alexander here also &c Att which day here came as well the afd. Alexander Stuart as the afd. Isaac Roads by their Attorneys afd. and hereupon the said Isaac prays further leave there -of to Imparle here until next court to be held at princess Ann Town the third Tuesday of November then next following and he hath it and the same day is given to the afd.
