hereupon the said William Waters complained against the afd. William Tompson in the plea afd. in
                                                   William Tompson
form following            Somerset fst ^ Late of somerset county planter was attached to answer unto
William Waters of a plea of trespass upon the case &c.       And Whereupon the said William Waters
by Litt Dennis his Atty complains that whereas the said William Tompson the twenty fifth day of
December Anno Dom. one thousand seven hundred and sixty at the county afd. Was indebted unto the
said William Waters in the sum of fifteen pounds current money for one pair of Water Grist mill stones
by the said William Waters to the said William Tompson before that time sold and delivered as by the account
thereof here into Court Brought doth appear and so thereof Indebted being in consideration thereof after
wards to wit the day and year afd. at the county upon himself did assume & to the said William Waters
then & there faithfully promise that he the said William Tompson the afd. sum of money to the said William
Waters when he should be thereto afterwards required he would pay and content Nevertheless the said William
Tompson his promise and assumption afd. in form afd. made not regarding the afd. sum of money unto the afd.
William Waters he hath not paid but he same to him to pay hath refused and still doth refuse altho
the same to do afterwards to wit the thirtieth day of December in the Year afd. at the county afd. and often since that
time by the said William Waters required to the damage of the said William Waters thirty pounds current money
and thereof he brings Suit &c.                                     J Doe, R Roe    pledges &c

And the afd. William Tompson by his Attorney afd. comes and defends the force & Injury when &c and prays
leave thereof to Imparle here until next court to be held at princess Ann Town the third tuesday of June
then next following and he hath it and the same day is given to the afd. William Waters here also &c
           Att which day here came as well the afd. William Waters as the afd. William Tomson by their
Attorneys afd. and hereupon the said William Tompson prays further leave thereof to Imparle here untill
next court to be held at princess Ann Town the third tuesday of August then next following and he
hath it and the same day is given to the afd. William Waters here also &c.
           Att which day here came as well the afd. William Waters as the afd. William Tompson by their
Attorneys afd. and hereupon the said William Tompson prays further leave thereof to Imparle here until
next court to be held at princess Ann Town the third tuesday of November then next following and he hath
it and the same day is given to the afd. William Waters here also &c
           Att which day here came as well the afd. William Waters as the afd. William Tompson by their
Attorneys afd. and hereupon the said William Tompson as before defends the force and Injury when &c.
And Saith that he cannot deny the action afd. of the afd. William Waters nor but that he did assume upon
himself in manner as the afd. William Waters above against him hath complained and as to the damage
of the same William Waters by him by occasion of the premisses in that part sustained the same William
Tompson saith and acknowledgeth that the afd. William Waters hath sustained damages by occasion of the
premisses beyond his costs and charges by him about his suit in that part opposed to fifteen pounds Curt money
and not more and because the said William Waters denies not this but the same Allegation grants to be true
prays Judgement for these Damages above acknowledged together with his costs and charges afd. to him to be
adjudged &c.              Therefore by consent of the parties afd. it is considered that the afd. William Waters
Recover against the afd. William Tompson his Damages afd. to the afd. Fifteen pounds by the afd. William Tompson
528    in form afd. acknowledged as also                                               pounds of Tobacco for his costs and charges
afd. to the same William Waters at his request by the court now here of the Assent of the parties afd. Adjudged
which certain Damages in the whole amount to fifteen pounds Curt Money and
528         pounds of Tobacco and the afd. William Tompson in Mercy &c

SW    Stephen Lank    Lank Late of somerset county planter if he should be found in his Bailywick and him should
safe keep so that he might have his body before the Justices of his Lordships county court of somerset to be held at
