November Court 1762 184 To the Worshipful the Justices of somerset county in court now Judicially sitting
that a commission may be granted him and commissioners appointed in order to prove the said Bounders or the Bounders of any other tract or tracts of Land on which the same may depend and your petitioner as in du -ty Bound shall every pray &c. Philip Covington Whereupon came here into court the afd. petitioner in his proper person and thereupon the petition afd. being read & heard & fully understood it is considered by the court here that a commission issue to the afd. Philip Covington as by the petition afd. is praid and that Levin Gale Levin Dashiell John Leatherbury & George Ir- ving of somerset county gent be commissioners and Execute the same commission according to act of assem -bly in such case provided &c.
much to the prejudice of your petitioner and as he apprehends that it will be very little further to carry the said Road on the line of the Land your petitioner between him & John Riggen & he will pray David Mathews Whereupon came here into court the afd. petitioner in his proper person and thereupon the petition afd. being read and heard & fully understood it is considered by the court here that Samuel Addams & Teague Riggan lay of the new road & Make Report to the court & that the new road be made as good & passable as the old road and that the old road lay open untill the new road be compleat
your petitioner therefore prays that your worships will grant a commission and appoint commissio -ners to take dipositions in order to prepetuate the same and your petitioner will pray Joshua Whittington Whereupon came here into court the afd. petitioner in his proper person and thereupon the petition afd. being read & heard & fully understood it is considered by the court here that a commission issue to the said Joshua Whittington as by the petition afd. is praid and that John Piper William Turpon Mitchel Da -shiell & John Kellum be commissioners & Execute the same commission according to act of assembly in such case provided &c
of almighty God that the above account as it stands stated is just and true and that he hath not directly or Indirectly received any part or parcell thereof security or satisfaction for the same more than credit given to his knowledged Before J Dennis August 19th 1762 Whereas it is made appear to my satisfaction by the Oath of Aaron Sterling that Daniel Clark stands Justly indebted unto him in the sum of seven pounds one shilling and four pence Current Money & that he hath absconded himself from justice and hath or is about to remove his Effects in order to defraud his credittors These are therefore in his Lordships Name to command you to issue an attachment against the goods Chattles Rights and Creditts of the said Daniel Clark to satisfie the said Aaron his debt afd. together with the contingent costs that shall accrue by means of Issuing the Attachment afd. agreeable to the act of assembly in such case made and provided & for so doing this shall be your Warrant Given under my hand & seal this day & Year afd. To Mr Thos. Hayward Jur Clk J Dennis |
