June Court 1760 18 Whereupon ye. said John Caldwell at ye. Prayer of ye. afd. Thomas Howard is adjudged to give special Bail to ye. Action afd. Thereupon a Certain Richard Waters of Somerset County Gentleman Present here in Court in his Proper person undertook for ye. said John Caldwell that if it should happen that Judgment in ye. plea afd. should be rendered for ye. said Thomas Howard against ye. afd. John Caldwell or that he ye. said John should be therein Convict that then he ye. said John should pay & satisfie unto ye. afd. Thomas ye. Judgment of the Court thereupon or render his Body in Execution of such Judgment to ye. Prison of ye. sherriffe of ye. County afd. in satisfaction thereof or that he ye. said Richard Waters will do ye. same for him &c. Whereupon ye. afd. John Caldwell puts in his place Littleton Dennis Gent. Attry at Law agt. ye. afd. Thomas Howard of the afd. plea And thereupon at ye. Prayer of ye. Parties afd. day is to them here now given untill ye. next Court to be held at Princes Ann Town ye third Tuesday of August then next following in ye state that now saving to ye. parties afd. &c. Att which day here Came ye. parties afd. by their Attys afd. And hereupon ye said Thomas Howard Complained of ye. afd. John Caldwell in ye. plea afd. in form following Somerset fst John Caldwell Late of Somerset County Mariner was Attached to Answer unto Thomas Howard of a plea of trespass upon ye. Case & so forth And Whereupon ye. said Thomas by William Hayward his Attry Complains that Whereas ye. said Thomas ye. Day of Anno Dom. MDCCLViii at ye. County afd. was possessed of one Hogshead of rum Containing Gallons of ye. Value of Twelve pounds fourteen shillings Current money of Maryland as of his proper Hogshead of rum & being so thereof possessed ye. said Thomas afterwards to wit ye. same day and year afd. out of his Hands and Possession Casually Lost Which said Hogshead of rum afterwards to wit ye. same day & year afd. to ye. Hands Possession of ye afd. John by finding did Come, Nevertheless the said John knowing it to be ye. Hogshead of rum of ye. afd. Thomas and to him ye. said Thomas of right to belong and Appertain but plotting and fraudulently INtending ye. said Thomas of ye. Hogshead of rum afd. Craftily and Subtilly to Deceive and Defraud the Hogshead of rum afd. tho often thereunto required to ye. said Thomas hath not Delivered but the Hogshead of rum afd. afterwards, to wit, on ye Day of Anno Dom. MDCCLViii at the County afd. to his own proper use did Convert and Dispose to ye. Damage of ye said Thomas fifteen Pounds Current money Maryland & thereof he brings suit &c Pledges &c. J. Doe & R. Roe afd And ye. afd. John Caldwell by Littleton Dennis his Atty ^ Comes and Defends ye. force & Injury when &c. And prays Leave thereof to Imnparle here untill next Court to to be held at Princes Ann Town ye third Tuesday of Novr. then next follg it & he hath ^ & the same day is given to ye afd.
