   June Court                  1760                  17
untill next Court to be held at Princes Ann Town &c. third Tuesday of March then next
following & he hath it & ye. same day is given to ye. afd. Thomas here also &c.
Att which day here Came as well ye. afd. Thomas as ye. afd. John By their attys.
afd. And hereupon ye. said John Prays further Leave thereof to Imparle here
untill next Court to be held at Princes Ann Town ye. third Tuesday of March
then next following & he hath it & ye. same day is given to ye afd. Thomas here also &c
Att which day here Came as well ye. afd. Thomas as ye. afd. John by their Attys afd.
And hereupon ye. said John as before Defends ye. force & Injury when &c. & saith
that he Cannot deny ye. action afd. of ye. afd. Thomas Howard nor but that he is
guilty of ye. Premisses in ye. Declaration in manner & form as ye. afd. Thomas
above against him hath Complained and as to ye. Damage of ye. same
            by
Thomas ^ by him by Occasion of ye. Premisses in that part sustained ye. same
John saith & acknowledgeth that ye. afd. Thomas hath sustained Damage
by Occasion of ye. premisses beyond his Costs and Charges by him abouth his
suit in that apposed to one penney Curt. money and not more & because ye.
afd. Thomas Denys not this but ye. same allegation grants to be true prays
Judgment for those Damages above acknowledged together with his Costs
and Charges afd. to him to be adjudged &c.
Therefore by Consent of ye. Parties afd. it is Considered that ye. afd. Thomas Howard
recover against ye. afd. John Caldwell his Damages afd. to ye. afd. sum of one penny
Cur. money by ye. same John in form afd. acknowledged as also
374      Pounds of Tobacco for his Costs and Charges afd. to the same Thomas at his request
by ye. Court now here of ye. Assent of ye. parties afd. adjudged which Certain
Damages in ye. whole amount to 1 penny Cur. money &
           Pounds of Tobacco & ye. afd. John in Mercy &c.

WH    Thomas Howard    Command was given to ye. Sherriffe of Somerset County that he

 vs    should take John Caldwell Late of Somerset County Mariner
LD    John Caldwell    if he should be found in his Bailywick & him should safe keep
so that he might have his Body before ye. Justices of his Lordships County Court of
Somerset to be held at Princes Ann Town ye. third Tuesday June Anno Dom. one
thousand seven hundred & fifty Eight to Answer unto Thomas Howard of a plea of tres:
:pass upon ye. Case &c.
And ye. same day is given to ye. afd. Thomas here And so forth
Att which day here Came ye. afd. Thomas Howard by William Hayward his
Atty. & ye. sherriffe to wit William Allen Gent. now here returned that he had taken
ye. afd. John Caldwell whose Body here at this day he had ready to answer ye. afd.
Thomas of ye. afd. Plea as to him it was Commanded
