17 Att Which day here came ye. Parties afd. by their Attys afd. And hereupon ye. said Thomas Howard Complained of ye. afd. John Caldwell in ye. plea afd. in form following Somerset fst John Caldwell Late of Somerset County Mariner was Attached to Answer unto Thomas Howard of a plea wherefore with force and Arms he ye. said in and upon him ye. afd. Thomas Howard at the County afd. an Assault Did make & him did beat wound & Evilly treat so that of his Life it was much Dispaired & other harms to him then and there did to the great Damage of ye. said Thomas And against the peace of ye. right Honble ye. Lord Propry that now is his good rule & Government &c. And Whereupon ye said Thomas by William Hayward his Attorney Complains that ye. afd. John ye. ii day of June Anno Dom. MDCCLViii with force and Arms in & upon him ye. afd. Thomas at Somerset County afd. an Assault did make & him then & there did beat wound and Evilly treat so that of his Life it was much dispaired And other harms to him then & there did to ye great Damage of ye said Thomas & against ye peace of ye. right Honrble ye Lord propry that now is his good rule & government &c. Whereupon ye. said Thomas says he is worse and have Damage to ye. value of Twenty Pounds Current money of Maryland & thereof he brings suit &c. Pledges &c. J: Doe & Ri: Roe ; ; afd. And ye. afd. John Caldwell by Littleton Dennis his Attry. ^ Comes & Defends ye. force and Injury when &c. And prays Leave thereof to Imparle here untill next Court to be held at Princes Ann Town ye. third Tuesday of November then next following & he hath it & ye. same day is given to ye. afd. Thomas here also &c. Came Att which day here ^ as well ye. afd. Thomas as ye. afd. John by their Attys afd. And hereupon ye. said John prays further Leave thereof to Imparle here untill next Court to be held at Princes Ann Town ye. third Tuesday of March then next following & he hath it & the same day is given to ye. afd. Thomas here also &c. Att Which day here Came as well ye. afd. Thomas as ye/ afd. John by their Attys afd. And hereupon ye. said John prays further Leave thereof to Imparle here untill next Court to be held at Princes Ann Town ye. third Tuesday of June then next follg. & he hath it & ye same day is given to ye. afd. Thomas here Also &c. Att Which day here Came as well ye. afd. Thomas as ye. afd. John by their Attys afd. And hereupon ye. said John prays further Leave thereof to Imparle here untill next Court to be held at Princes Ann Town ye. third Tuesday of Augt. then next following & he hath it & ye. same day is given to ye. afd.
