August Court 1762 171 Somerset fst James Lawless Late of Somerset County Carpinter Otherwise Called I James Lawless of Somerset County in the Province of Maryland Carpinter was Summoned to Answer unto Stephen Mills Assignee According to Act of Assembly in Such Case made and provided of Samuel Addams of A plea that he Render unto him the full And Just Sum of Twenty One Pounds Curt Money of Maryland which to him he Owes and Unjustly detains &c And Whereupon the Said Stephen Mills by William Hayward his Attorney Saith that Whereas the afd. James Lawless the Nineteenth day of August in the Year of our Lord One thousand Seven hundred Sixty and one at Somerset County afd. by his Certain Writing Obligatory had Granted himself to be held and firmly bound unto Samuel Addams in the Sum of Twenty One pounds Curt Money afd. to be paid unto the Said Samuel or his Assigns when he Should be thereto Afterwards Required the Said Samuel Afterwards (to wit the Twelfth day of December in the Year of our Lord One thousand Seven hundred Sixty and One at the County afd. the afd. Sum of Twenty One pounds Curt Money afd. or Any part thereof in no Sort paid or Satisfyed being by a Writing on the Said Writing Obligatory made with his hand Subscribed bearing date the day and Year Last mentioned According to the force form and Effect of the Act of Assembly afd. the Same Writing Obligatory and the Sum therein Mentioned unto the Said Stephen Mills did Assign whereof the Said James afterwards to wit the Same day & Year Last afd. at the County afd. had Notice by Reason of which Premisses Action hath Accrewed unto the Said Stephen to demand and have from the Said James the Sum of Money in the Writing Obligatory Mentioned Nevertheless the afd. James altho often Required the Said Sum of Twenty One pound Curt Money afd. unto the Said Samuel or unto the Said Stephen Yet hath not Rendred but that unto them to Render hath Gainsayed and the Same James the Same unto the Said Stephen to Render Still doth Gainsay & unjustly detain to the Damage of the Same Stephen the Sum of twenty One pounds Curt Money afd. and thereof he brings Suit &c. and brings here into Court as well the Writing Obligatory as the Assignment afd. Which Testifie the Assignment and the debt &c Pledges &c. J: Doe & R: Roe And the afd. James Lawless by his Attorney afd. Comes and defends the force and Injury when &c. And prays Leave thereof to Imparle here untill Tuesday of August then next following and he hath it and the Same day is given to the afd. Stephen here also &c. as well Att which day here Came ^ the afd. Stephen Mills as the afd. James Lawless by their Attorneys afd. And hereupon the Said James as before defends the force and Injury when &c. And Saith that he Cannot deny the Action afd. of the afd. Stephen Mills Assignee as afd. nor but that he Owes the afd. Stephen Assignee as afd. the afd. Twenty One pounds Curt Money in Manner and form as the afd. Stephen Above Against him hath declared Therefore it is Considered that the afd. Stephen Mills Gar. as afd. Recover Against the afd. James Lawless his Debt afd. and his Damages by Occasion of the detention of 244 that Same debt to Pounds of tobacco to the Same Stephen of his Assent by the Court here Adjudged and the afd. James in Mercy &c
Somerset to be held at Princes Ann Town the third Tuesday of June Anno Dom. 1762 to Answer unto John Dennis of A plea of trespass upon the Case &c. And the Same day is given to the afd. John here &c. Att which day here Came the afd. John Dennis by William Hayward his Attorney and the Sheriff to witt Ephraim Wilson now here Returned that he had taken the afd. William Figgs whose body here at this day he had Ready to Answer the afd. John Dennis of the afd. plea as to him it was Commanded Whereupon the Said William Figgs at the prayer of the afd. John Dennis is Adjudged to give Special bail to the Action afd. Thereupon a Certain John Cox and Abraham Dean present here in and Each of them undertook for Court in their proper persons and undertook ^ for the Said William Figgs and Assumed upon themselves that if Should happen that Judgment in the plea afd. Should be Rendred for the Said John Dennis Against the afd. William Figgs or that he the Said William Figgs Should be therein Convict that then he the Said William Should pay and Satisfie unto the afd. John the Judgment of the Court thereupon or Render his body in |
