WH LD    Ezekiell Mathis

@    Command was Given to the Sheriff of Somerset County that he Should take Elijah
SW    Elijah Mathis    Mathews Late of Somerset County Planter Otherwise Called Elijah Mathews of Somerset County
in the Province of Maryland if he Should be found in his Bailywick and him Should Safe keep so that he might
have his body before the Justices of his Lordships County Court of Somerset to be held at Princes Ann Town the
third Tuesday of November Anno Dom. one thousand Seven hundred and Sixty to Answer unto Ezekiell
Mathis of A plea that he Render him the Sum of Seventy Eight pounds Curt Money of Maryland which to him he
Owes and unjustly detains and So forth And the Same day is Given to the afd. Ezekiell here &c
             Att which day here Came the afd. Ezekiell Mathis by Littleton Dennis his Attorney and the
Sheriff to witt John Dennis Gent now here Returned that he had taken the afd. Elijah Mathis whose body here
at this day he had Ready to Answer the afd. Ezekiell Mathis of the afd. plea as to him it was Commanded
             Whereupon the Said Elijah Mathews at the prayer of the afd. Ezekiell Mathews is
Adjudged to Give Special Bail to the Action afd.    Thereupon a Certain Benjamin Benston of Somerset
County Planter present here in Court in his Proper Person undertook for the Said Elijah Mathews and
Assumed upon himself that if it Should happen that Judgment in the plea afd. Should be Rendred for the
Said Ezekill Mathis Against the afd. Elijah Mathis or that he the Said Elijah Should be therein Convict
that then he the Said Elijah Should pay and Satisfie unto the afd. Ezekiell the Judgment of the Court thereupon
or Render his body in Execution of Such Judgment to the prison of the Sheriff of the County afd. in Satisfaction
thereof or that he the Said Benjn. Benston will do the Same for him &c
             And thereupon the Said Elijah Mathews puts in his place Samuel Wilson Gent Attorney
at Law Against the afd. Ezekiell Mathews of the afd. plea
        And thereupon at the prayer of the parties afd. day is to them now here Given untill next Court
to be held at Princes Ann Town the third Tuesday of March then next following in the State that now
Saveing to the Parties afd. &c And thereupon Att which day here Came the parties afd. by their Attorneys
afd. And hereupon the Said Ezekill Mathis declared Against the afd. Elijah in the plea afd. in form following
Somerset fst Elijah Mathews Late of Somerset County Planter Otherwise Called Elijah Wood of Somerset
County in the Province of Maryland was Summoned to Answer unto Ezekiell Mathews of A plea that he Render
him Seventy Eight Pounds Curt Money which to him he Owes and Unjustly detians &c
           And Whereupon the Said Ezekiell by Littleton Dennis his Attorney Says that Whereas the Said
Elijah the xxi day of August Anno Dom. MDCCLIX at the County afd. by his Certain Writing Obligatory
which the Said Ezekiell Sealed with the Seal of the afd. Elijah here in Court Shews whose date is the day and Year
did Acknowledge himself to be held and firmly bound unto the Said Ezekiell in the afd. Sum of Seventy Eight pounds
Curt Money to be paid unto the Said Ezekiell when he Should be thereto Afterwards Required he would pay &
Content Nevertheless the afd. Elijah altho often Required the afd. Sum of Money unto the Said Ezekiell
he hath not Rendred but the Same to him to Render hath denyed and Still doth deny and Unjustly detain
Whereupon the Said Ezekiell Says he is Worse and hath damage to the Value of One hundred pounds Curt Money &
thereof he brings Suit &c.                                                                   Pledges &c. J: Doe & R: Roe
        And the afd. Elijah Mathews by his Attorney afd. Comes and defends the force and Injury when &c.
And Prays Leave thereof to Imparle here untill next Court to be held at Princes Ann Town the third Tuesday
of June then next following and he hath it and the Same day is Given to the afd. Ezekiell here also &c
             Att which day here Came as well the afd. Ezekiell Mathews as the afd. Elijah Mathews by
their Attorneys afd. And hereupon the Said Elijah prays further Leave thereof to Imparle here untill next
Court to be held at Princes Ann Town the third Tuesday of August then next following and he hath it and the
Same day is Given to the afd. Ezekiell here also &c
             Att which day here Came as well the afd. Ezekiell Mathews as the afd. Elijah Mathews by
their Attorneys afd. And hereupon the Said Elijah prays further Leave thereof to Imparle here untill
Next Court to be held at Princes Ann Town the third Tuesday of November then next following and he hath
it And the Same day is Given to the afd. Ezekiell here also &c.
