August Court 1762 169 here in Court in his proper Person undertook for the Said Isaac Mathews and Assumed upon himself that if it Should happen that Judgment in the plea afd. Should be Rendred for the Said Ezekiell Mathews Against the afd. Isaac Mathews or that he the Said Isaac Mathews Should be therein Convict that then he the Said Isaac Should pay & Satisfie unto the afd. Ezekiell the Judgment of the Court thereupon or Render his body in Execution of Such Judgment to the Prison of the Sheriff of the County afd. in Satisfaction thereof or that he the Said Benjn. will do the Same for him &c Whereupon the Said Isaac Mathis puts in his place Saml. Wilson Gent Attorney at Law Against the afd. Ezekiell Mathis of the afd. plea And thereupon at the prayer of the parties afd. day is to them now here Given untill next Court to be held at Princes Ann Town the third Tuesday of March then next following in the State that now Saveing to the parites afd. &c. Att which day here Came the parties afd. by their Attorneys afd. Isaac And hereupon the Said Ezekiell declared Against the afd. Isaac in the plea afd. in form following Somerset fst Mathis Late of Somerset County Planter Otherwise Called Isaac Mathis of Somerset County in the province of Maryland was Summoned to Answer unto Ezekiell Mathis of A plea that he Render him Seventy Eight pounds Curt Money which to him he Owes and unjustly detains &c. And Whereupon the Said Ezekiell by Littn Dennis his Attorney Says that Whereas the Said Isaac the xxi day of August Anno Dom. MDCCLIX at the County afd. by his Certain Writing Obligatory which the Said Ezekiell Sealed with the Seal of the afd. Isaac here in Court Shews whose date is the day and Year did Acknowledge himself to be held and firmly bound unto the Said Ezekiell in the afd. Sum of Seventy Eight pounds Curt Money to be paid unto the Said Ezekiell when he Should be thereto Afterwards Required he would pay and Content Nevertheless the afd. Elijah altho often Required the afd. Sum of Money unto the Said Ezekiell he hath not paid but the Same to him to Render hath denyed and Still doth deny and Unjustly detain Whereupon the Said Ezekiell Says he is Worse and hath damage to the Value of One hundred pounds Curt Money and thereof he brings Suit &c Pledges &c. J: Doe & R: Roe And the afd. Isaac Mathis by his Attorney afd. Comes and defends the force and Injury when &c And prays Leave thereof to Imparle here untill next Court to be held at Princes Ann Town the third Tuesday of June then next following and he hath it and the Same day is Given to the afd. Ezekiell here also &c Att which day here Came as well the afd. Ezekiell Mathis as the afd. Isaac Mathis by their Attorneys afd. And hereupon the Said Isaac prays further Leave thereof to Imparle here untill next Court to be held at Princes Ann Town the third Tuesday of August then next following and he hath it and the Same day is Given to the afd. Ezekiell here also &c Att which day here Came as well the afd. Ezekiell Mathis as the afd. Isaac Mathis by their Attorneys afd. And hereupon the Said Isaac as before defends the force and Injury when &c. And Cannot deny the Action afd. of the afd. Ezekiell nor but that the Writing Obligatory afd. is the deed of him the Said Isaac nor but that he Owes the afd. Ezekiell the afd. Seventy Eight pounds Curt Money in Manner and form as the afd. Ezekiell Above Against him hath declared Therefore it is Considered that the afd. Ezekiell Mathis Recover Against the afd. Isaac Mathis his Debt afd. and his Damages by Occasion of the detention of that Same debt 302 to: Pounds of tobacco to the Same Ezekiell of his Assent by the Court here Adjudged And the afd. Isaac in Mercy &c |
