But that he did Assume upon himself in manner and form as ye. afd. Thomas above

Against him hath Complained and as to ye. Damage of ye. Same Thomas ^ him by
Occasion of ye. premisses in that part sustained ye. same David saith & acknowledg:
:eth that ye. afd. Thomas hath sustained Damages by Occasion of ye. Premises
beyond his Costs and Charges by him about his Suit in that part apposed to four
pounds Current money and not more & because ye. afd. Thomas denys not this but
ye. same allegation grants to be true prays Judgment for those Damages above
acknowledged together with all Costs & Charges afd. to him to be adjudged &c
Therefore by Consent of ye parties afd. it is Considered that ye. afd. Thomas Clark:
:son recover against ye. afd. David Wilson his Damages afd. to ye. afd. four pounds
Current money by the same David in form afd. acknowledged as also
425       Pounds of Tobacco for his Costs & Charges afd. to ye. same Thomas at his request
by ye. Court now here of ye Assent of ye parties afd. Adjudged which Certain Damages
in ye Whole Amount to four pounds Curt. money &
      Pounds of Tobacco & ye. afd. David in Mercy &c.

WH    Thomas Howard    Command was Given to ye. Sherriffe of Somerset County that he

 vs    should take John Caldwell Late of Somerset County Mariner
LD    John Caldwell    if he should be found in your Bailywick and him should
safe keep so that he might have his Body before ye. Justices of his Lordships County Court
of Somerset to be held at Princes Ann Town ye third Tuesday of June Anno Dom. one thousand
seven hundred & fifty Eight to answer unto Thomas Howard of a plea wherefore with force and
Arms he the said John in & upon him ye afd. Thomas at ye. County afd. an Assault did make
and him did
^ beat wound & Evilly treat so that of his Life it was much dispaired & other harms to him then &
there did to ye. great Damage of ye. said Thomas and against our peace that now is & so forth
And ye same day is given to ye. afd. Thomas here and so forth
Att which day here came the afd. Thomas Howard by William Hayward his Attry & ye.
Sherriffe to wit William Allen Gent. now here returned that he had taken ye afd. John John Caldwell
Whose Body here at this day he had ready to Answer ye. afd. Thomas Howard of ye afd. plea as
to him it was Commanded
Whereupon ye. said John Caldwell at ye prayer of ye. afd. Thomas Howard is adjudged to
give special Bail to ye. Action afd. Thereupon A Certain Richard Waters of Somerset
County Gentleman Present here in Court in his proper person undertook for ye. said
John Caldwell that if it should happen that Judgment in ye. plea afd. should be rendd.
for ye. said Thomas Howard Against ye afd. John Caldwell or that he the said John
should be therein Convict that then the said John should pay and satisfie unto ye.
Afd. Thomas ye. Judgment of ye. Court thereupon or render his Body in Execution of
such Judgment to the prison of ye. sherriffe of ye. County afd. in satisfaction thereof
or that he ye. said Richard Waters will do ye. same for him &c
Whereupon ye. afd. John Caldwell puts in his place Littleton Dennis Gent.
Attorney at Law against ye. afd. Thomas Howard of ye. afd. plea
And thereupon & the prayer of ye. Parties afd. day is to them now here given
untill ye next Court to be held at Princes Ann Town ye third Tuesday of Augt.
then next follg in ye state that now saving to ye. parties afd. &c.
