August Court 1762 162 Henry hath not paid but the Same to the Said Henry to pay hitherto altogether hath Refused and Still doth Refuse And unjustly detain Whereupon the Said Henry Says he is Worse and hath damage to the Value of Twenty pounds Curt Money of Maryland and thereof he brings Suit &c Pledges &c. J: Doe & R: Roe And the afd. John Roberson in his proper person Cometh and Defendeth the force and Injury when &c And prays Leave thereof to Imparle here untill next Court to be held at Princes Ann Town the third Tuesday of August then next following and he hath it and the Same day is Given to the afd. Henry here also &c Att which day here Came as well the afd. Henry Lowes Jr by his Attorney afd. as the afd. John Roberson in his Proper person and thereupon the Said John Roberson as before defends the force and Injury when &c. And Saith that he Cannot deny the Action afd. of the afd. Henry Lowes nor but that the Writing Obligatory afd. is the deed of him the Said John nor but that he Owes the afd. Henry the afd. Ten pounds Eleven Shillings and three pence Curt Money in Manner and form as the afd. Henry Above Against him hath declared Therefore it is Considered that the afd. Henry Lowes Recover Against the afd. John Roberson his Debt afd. and his Damages by Occasion of the detention of that Same debt to 198 1/4 Pounds of Tobacco to the same Henry of his Assent by the Court here Adjudged & the afd. John in Mercy &c
the third Tuesday of March Anno Dom. one thousand Seven hundred and Sixty Two to Answer unto Nicholas McCubbin of A plea that he Render unto him the Sum of fifty Six pounds ten Shillings Curt Money of Maryland which to him he Owes and Unjustly detains &c. And the Same day is Given to the afd. Nicholas here Att which day here Came the afd. Nicholas McCubbin by Samuel Wilson his Attorney and the Sheriff to witt Ephraim Wilson now here Returned that he had taken the afd. John Tyler whose body here at this day he had Ready to Answer the afd. Nicholas McCubbin of the afd. plea as to him it was Commanded Whereupon the Said John Tyler at the prayer of the afd. Nicholas McCubbin is Adjudged to Give Special Bail to the Action afd. thereupon a Certain Thomas Tyler of Somerset County planter present here in Court in his proper person undertook for the Said John Tyler and Assumed upon himself that if it Should happen that Judgment in the plea afd. Should be Rendred for the Said Nicholas McCubbin Against the afd. John Tyler or that he the Said John Tyler Should be therein Convict that then he the Said John Tyler Should pay and Satisfie unto the afd. Nicholas McCubbin the Judgment of the Court thereupon or Render his body in Execution of Such Judgment to the prison of the Sheriffe of the County afd. in Satisfaction thereof of that he the Said Thomas Tyler will do the Same for him &c Whereupon the Said John Tyler Gent Attorney at Law Against the afd. Nicholas McCubbin of the afd. plea And thereupon at the prayer of the parties afd. day is to them now here Given untill next Court to be held at Princes Ann Town the third Tuesday of June then next following in the State that now Saveing to the parties afd. Att which day here Came the parties afd. by their Attorneys afd. And hereupon the Said Nicholas declared Against the afd. John in the plea afd. in form following Somerset fst John Tyler Late of Somerset County Planter Otherwise Called I John Tyler of Somerset County in the province afd. Waterman was Summoned to Answer unto Nicholas Macubbin of A plea that he Render unto him the Sum of fifty Six pound Ten Shillings Curt Money of Maryland which to him he Owes and Unjustly detains &c. And Whereupon the Said Nicholas by Samuel Wilson his Attorney Says that whereas the Said John on the Twenty Ninth day of November in the Year of our Lord God Seventeen hundred and fifty five at the County afd. by his Certain Writing Obligatory which the Said Nicholas Sealed with the Seal of the Said John here to the Court Shews the date whereof is the Same day and Year afd. Acknowledged himself to be bound to the Said Nicholas in the full and Just Sum of fifty Six pounds Ten Shillings Curt of the Value of fifty Six pounds |
