August Court 1762 162 Saith that he Cannot deny the Action afd. of the afd. Samuel Wilkins nor but that he did Assume upon himself in Manner and form as the afd. Samuel Above Against him hath Complained and as to the Damage of the Same Samuel by him by Occasion of the Premisses in that part Sustained the Same William Saith & Acknowledgeth that the afd. Samuel hath Sustained Damages by Occasion of the premisses beyond his Costs and Charges by him About his Suit in that part Apposed to four pound five Shillings and five pence Curt Money of Maryland and not More and because the afd. Samuel denys not this but the Same Allegation Grants to be true prays Judgment for those Damages above Acknowledged together with his Costs and Charges afd. to him to be Adjudged &c Therefore by Consent of the parties afd. it is Considered that the afd. Samuel Wilkins Recover Against the afd. William Geddes his Damages afd. to the afd. four pound five Shillings & five pence Curt Money by the Same William in form afd. Acknowledged as also Pounds of Tobacco for his Costs and Charges afd. to the Same Samuel at his Request by the Court now here of the Assent of the parties afd. Adjudged which Certain Damages in the Whole Amount to four pound five Shillings & 195 1/2 five pence Curt Money and Pounds of tobacco and the afd. William in Mercy &c
his body before our Justices of our County Court of Somerset to be held at Princes Ann Town the third Tuesday of March Anno Dom. one thousand Seven hundred and Sixty Two to Answer unto Henry Lowes Jur. of a plea Maryland which to him he Owes and unjustly detains and So forth And the Same day is given to the afd. Henry here &c. Att which day here Came the afd. Henry Lowes by George Hayward his Attorney and the Sheriffe to witt Ephraim Wilson now here Returned that he had taken the afd. John Roberson whose body here at this day he had Ready to Answer the afd. Henry Lowes of the afd. plea as to him it was Commanded Whereupon the Said John Robertson at the prayer of the afd. Henry Lowes is Adjudged to Give Special bail to the Action afd. Thereupon a Certain Levin Ballard of Somerset County Gent present here in Court in his proper person undertook for the Said John Roberson and Assumed upon himself that if it Should happen that Judgment in the plea afd. Should be Rendred for the Said Henry Lowes Against the afd. John Roberson or that he the Said John Roberson Should be therein Convict that then he the Said John Should pay and Satisfie unto the afd. Henry the Judgment of the Court thereupon or Render his body in Execution of Such Judgment to the Prison of the Sheriff of the County afd. in Satisfaction thereof or that he the Said Levin Ballard will do the Same for him &c. Whereupon is to them now here Given untill next Court to be held at Princes Ann Town the third Tuesday of June then next following in the State that now Saveing to the parties afd. &c Att which day here Came as well the afd. Henry Lowes by his Attorney afd. as the afd. John Roberson in his Proper Person and thereupon the Said Henry Lowes Declared Against the afd. John Roberson in the plea afd. in form following Somerset fst John Robison Late of Somerset County Blacksmith Otherwise Called I was John Robertson of Somerset County Blacksmith was Summoned to Answer unto Henry Lowes Jr of A plea that he Render unto him the Sum of Ten pound Eleven Shillings and three pence Curt Money of Maryland which to him he Owes and unjustly detains and So forth And Whereupon the Said Henry by George Hayward his Attorney Says that Whereas the Said John the Twentieth day of November in the Year of our Lord One thousand Seven hundred Sixty and One at the County afd. by his Certain Bill Obligatory which the Said Henry Sealed with the Seal of the Said John and to the Court here Shews the date whereof is the Same day and Year afd. Acknowledged himself to Owe and be Indebted unto the Said Henry in the Sum of Ten pounds Eleven Shillings and three the Said Henry when he the Said John Should be thereto afterwards Required to which payment well and truly to be made and done the Said John did bind himself firmly by the Same Bill Nevertheless the Said John tho often thereto Required the afd. Sum of Ten pounds Eleven Shillings and three pence Curt Money afd. to the Said |
