August Court 1762 161 Anno Dom. one thousand Seven hundred and Sixty One to Answer unto Samuel Wilkins of A plea of trespass upon the Case &c And the Same day is Given to the afd. Samuel here &c Att which day here Came the afd. Samuel Wilkins by Samuel Wilson his Attorney and the Sheriff to witt John Dennis Gent now here Returned that he had taken the afd. William Geddes whose body here at this day he had Ready to Answer the afd. Samuel Wilkins of the afd. plea as to him it was Commanded Whereupon the Said William Geddes puts in his place Wm. Hayward Gent Attorney at Law Against the afd. Samuel Wilkins of the afd. plea And thereupon at the prayer of the parties afd. day is to them now here Given untill next Court to be held at Princes Ann Town the third Tuesday of March then next following in the State that now Saveing to the parties afd. &c Att which day here Came the parties afd. by their Attorneys afd. And hereupon the Said Samuel Complained Against the afd. William in the plea afd. in form following Somerset fst William Geddes Late of Somerset County Merchant was Attached to Answer unto Samuel Wilkins of A plea of trespass upon the Case &c And Whereupon the Said Samuel Wilkins by Samuel Wilson his Attorney Complains that whereas the Said William Geddes on the Seventh day of June in the Year of our Lord God Seventeen hundred and Sixty one at the County afd. was Indebted unto him the Said Samuel Wilkins in the Sum of Six pounds and two pence half penny Curt Money of Maryland for the Severall Matters and things in the Account hereto Annexed mentioned and Specified And So thereof indebted being in Consideration thereof Afterwards to wit the day and Year afd. at the County afd. upon himself did Assume and to the Said Samuel then and there faithfully promise that he the Said William the Said Sum of Money to the Said Samuel when he the Said William Should be thereto Afterwards Required he would well And faithfully pay and Content Yet the Said William his Promise and Assumption so as afd. made not Regarding but plotting and fraudulently intending him the Said Samuel in that part Craftily and Subtilly to deceive and defraud the Said Sum of Money afd. to the Said Samuel or Any part thereof hath not paid or Contented but the Same to him to pay hitherto hath Refused and Still doth Refuse altho thereto Afterwards to wit the day and Year afd. at the County afd. and often Since by the Said Samuel Required to the Damage of the Said Samuel Ten pounds Curt Money of Maryland and therefore he brings Suit &c Pledges &c. J: Doe & R: Roe
Stated Against William Geddes is Just and true and that he hath not Recd. Any part thereof nor Any Security or Satisfaction for the Same before Thos. Jones And the afd. William Geddes by his Attorney afd. Comes and defends the force and Injury when &c. And prays Leave thereof to Imparle here untill next Court to be held at Princes Ann Town the third Tuesday of June then next following and he hath it and the Same day is Given to the afd. Samuel here also &c Samuel Att which day here Came as well the afd. ^ Wilkins as the afd. William Geddes by their Attorneys afd. And hereupon the Said William Geddes prays further Leave thereof to Imparle here untill next Court to be held at Princes Ann Town the third Tuesday of August then next following and he hath it and the Same day is given to the afd. Samuel here also &c Att which day here Came as well the afd. Samuel Wilkins as the afd. William Geddes by their Attorneys afd. And hereupon the Said William as before defends the force and Injury when &c. and Saith |
