John and Phillip Recover Against the afd. William their Debt afd. and their Damages by Occasion of the detention of 332 3/4 that Same debt to Pounds of tobacco to the Same John and Phillip of their Assent by the Court here Adjudged And the afd. William in Mercy &c
the Justices of his Lordships County Court of Somerset to be held at Princes Ann Town the third Tuesday of June Anno Dom. one thousand Seven hundred and Sixty One to Answer unto John Cail and Phillip Walker of A plea that he Render them One hundred and Twenty Pounds Seventeen Shillings and Eight pence Curt Money of Maryland which to them he Owes and Unjustly detains and So forth And the Same day is Given to the afd. John & Phillip here &c &2 Att which day here Came the afd. John Cail and Phillip Walker by Wm. Hayward their Attorney And the Sheriff to witt John Dennis Gent now here Returned that he had taken the afd. William Nutter whose body here at this day he had Ready to Answer the afd. John Cail and Phillip Walker of the afd. plea as to him it was Commanded Whereupon the Said William Nutter at the prayer of the afd. John Cail and Phillip Walker is Adjudged to give Special Bail to the Action afd. Thereupon a Certain William Adams of Somerset County Gent present here in Court in his proper person undertook for the Said William Nutter and Assumed upon himself that if it Should happen that Judgment in the plea afd. Should be Rendred for the Said John Cail & Phillip Walker Against the afd. William Nutter or that he the Said William Nutter Should be therein Convict that then he the Said William Nutter Should pay and Satisfie unto the afd. Cail and Walker the Judgment of the Court thereupon or Render his body in Execution of Such Judgment to the prison of the Sheriff of the County afd. in Satisfaction thereof or that he the Said William Adams will do the Same for him &&. H Whereupon the Said William Nutter puts in his place Littleton Dennis Gent Attorney at Law Against the afd. John Cail and Phillip Walker in the afd. plea And thereupon at the prayer of the parties afd. day is to them now here Given untill next Court to be held at Princes Ann Town the third Tuesday of August then next following in the State that now Saveing to the parties afd. &c. Att which day here Came the parties afd. by their Attorneys afd. And hereupon the Said John & Phillip declared Against the afd. William in the plea afd. in form following Somerset fst William Nutter Late of Somerset County Planter Otherwise Called I William Nutter of Somerset County in the Province of Maryland Planter was Summoned to Answer unto John Caile and Phillip Walker of A plea that he Render them One hundred and Twenty pounds Seventeen Shillings |
