Bailywick and him Should Safe keep so that he might have his body before the Justices of his Lordships
County Court of Somerset to be held at Princes Ann Town the third Tuesday of June Anno Dom. one
thousand Seven hundred and Sixty One to Answer unto Phillip Walker and John Cail of a plea that he
Render them One hundred and Twenty Pounds Seventeen Shillings and Eight pence Curt Money of Maryland
which to them he Owes and unjustly detains and So forth And the Same day is Given to the afd. John &
Phillip here &c       Att which day here Came the afd. John Cail & Phillip Walker by Wm. Hayward his
Attorney and the Sheriff to witt John Dennis Gent now here Returned that he had taken the afd. William
Nutter whose body here at this day he had Ready to Answer the afd. John and Phillip of the afd. plea
as to him it was Commanded    Whereupon the Said William Nutter at the prayer of the afd. John
Cail and Phillip Walker is Adjudged to give Special bail to the Action afd. Thereupon a Certain
William Addams of Somerset County Gent present here in Court in his proper person undertook
for the Said William Nutter and Assumed upon himself that if it Should happen that Judgment
in the plea afd. Should be Rendred for the Said John & Phillip Against the afd. William Nutter or that
he the Said Nutter Should be therein Convict that then he the Said Nutter Should pay and Satisfie
unto the afd. Cail and Walker the Judgment of the Court thereupon or Render his body in Execution of
Such Judgment to the Prison of the Sheriff of the County afd. in Satisfaction thereof or that he
the Said William Adams will do the Same for him &c
        Whereupon the Said Wm. Nutter puts in his place Littleton Dennis Gent Attorney at
Law Against the afd. John Cail and Phillip Walker in the afd. plea
           And thereupon at the prayer of the parties afd. day is to them now here Given untill next
Court to be held at Princes Ann Town the third Tuesday of August then next following in the State that
now Saveing to the Parties afd. &c
             Att which day here Came the parties afd. by their Attorneys afd. And hereupon the Said
Cail and Walker Declared Against the afd. Wm. Nutter in the plea afd. in form following
Somerset fst William Nutter Late of Somerset County Planter Otherwise Called I William Nutter
of Somerset County in the Province of Maryland Planter was Summoned to Answer unto John Cail and
Philip Walker of A plea that he Render them One hundred and Twenty Pounds Seventeen Shillings &
Eight pence Curt Money of Maryland which to them he Owes and Unjustly detains and So forth
   And Whereupon the Said John and Philip by William Hayward their Attorney Say that whereas
the Said William Nutter on the Seventh day of May in the Year of our Lord One thousand Seven
hundred and Sixty at the County afd. by his Certain Writing Obligatory which with the Seal of the Said
William Nutter Sealed the Said John and Phillip here into Court bring the date whereof is the Same day
And Year had Acknowledged himself to be held and firmly bound to one Hall Caile now decd (whom the
Said John and Phillip Survived) And the Said John and Phillip in the Sum of One hundred and Twenty pounds
Seventeen Shillings and Eight pence Curt Money to be paid to them the Said Hall John and Philip when
he the Said William Nutter Should be thereot afterwards Required Nevertheless the afd. William
Nutter (tho often Required) hath not paid the afd. One hundred and Twenty Pounds Seventeen Shillings
and Eight pence Curt Money to the Said Hall John and Phillip or Any of them in the Lifetime of the
Said Hall or to the John and Phillip or Either of them Since the death of the Said Hall (whom the
Said John and Phillip Survived) but hath Refused to pay the Same and doth Still Refuse to pay the
Same to Said John and Philip Whereupon they Say they are Injured and have Damage to the Value of
One hundred and Twenty Pounds Seventeen Shillings and Eight pence Curt Money of Maryland and
thereupon they bring Suit and So forth                                          Pledges &c J: Doe & R: Roe
      And the afd. Wm. Nutter by his Atty Comes and defends the force and Injury when &c. And prays
Leave thereof to Imparle here untill next Court to be held at Princes Ann Town the third Tuesday of
November then next following and he hath it and the Same day is Given to the afd. John & Phillip here &c
        Att which day here Came as well the afd. John Cail and Phillip Walker as the afd. William
Nutter by their Attorneys afd. And hereupon the Said William prays further Leave thereof to Imparle
