And Whereupon the Said Smith by William Hayward his Attorney Says that Whereas the Said Cornelius Ward and
Cornelius Ward Jur. on the twenty first day of December in the Year of our Lord One thousand Seven hundred fifty &
Six at Somerset County afd. by his Certain bill Obligatory Sealed with the Seal of the Said Cornelius Ward and
Cornelius Ward Jur. and to the Court here Shewn the date whereof is the Same day and Year Acknowledged themselves
to be indebted unto the Said Smith Horsey in the Sum of fifty Two pounds and Eight Shillings Curt Money of Maryland
to be paid unto the Said Smith Horsey when they the Said Cornelius Ward and Cornelius Ward Jr Should be thereto
Afterwards Required and to the Said Payment Well and truly to be made the Said Cornelius Ward and
Cornelius Ward Jur. by the Said Bill firmly bound themselves their heirs Exrs. and Admrs. in the Said Sum of One
hundred and four pounds and Sixteen Shillings Curt Money of Maryland and the Said Smith in fact Says that he
afterwards to wit the Same day and Year afd. at the County afd. did Require the Said Cornelius Ward and Cornelius
Ward Jur. to pay unto him the Said Smith the afd. Sum of fifty Two pounds and Eight Shillings Curt Money afd.
According to the form and Effect of the Said Bill which they to do then and there altogether Refused whereby
Action hath Accrewed to the Said Smith to demand and have of the Said Cornelius Ward and Cornelius Ward Jur
the Said One hundred and four pounds and Sixteen Shillings Curt Money afd. Nevertheless the Said Cornelius
Ward and Cornelius Ward Jr (altho often Required the afd. One hundred and four pounds and Sixteen Shillings
Curt Money afd. have not as yet unto the Said Smith Horsey paid or hath Either of them the Same unto him paid
but that to do altogether hitherto have and Each of them have Refused and Still do and Each of them doth
Refuse and Unjustly deny Whereupon the Said Smith Horsey Says he is Worse and hath damage to the
Value of One hundred and four pounds and Sixteen Shillings Curt Money of Maryland and thereof he
brings his Suit and So forth                                                              Pledges &c. J: Doe & R: Roe
      And the afd. Cornelius Ward & Cornelius Ward Jr by their Attorneys afd. Come and defend the force &
Injury when &c. And pray Leave thereof to Imparle here untill next Court to be held at Princes Ann Town
the third Tuesday of November then next following and they have it and the Same day is Given to the afd.
Smith here also &c.    Att which day here Came as well the afd. Smith Horsey as the afd. Cornelius Ward & Cornelius
Ward Jr by their Attorneys afd. And hereupon the Said Wards, pray further Leave thereof to Imparle here untill
next Court to be held at Princes Ann Town the third Tuesday of March then next following and they have it &
the Same day is Given to the afd. Smith here also &c.
           Att which day here Came as well the afd. Smith Horsey as the afd. Cornelius Ward & Cornelius Ward Jr
by their Attorneys afd. And hereupon the Said Wards pray further Leave thereof to Imparle here untill next
Court to be held at Princes Ann Town the third Tuesday of June then next following and they have it and
the Same day is Given to the afd. Smith here also &c
           Att which day here Came as well the afd. Smith Horsey as the afd. Cornelius Ward and Cornelius
Ward Jur by their Attorneys afd. And hereupon the Said Wards, pray further Leave thereof to Imparle
here untill next Court to be held at Princes Ann Town the third Tuesday of August then next following
And they have it and the Same day is Given to the afd. Smith here also &c
           Att which day here Came as well the afd. Smith Horsey as the afd. Cornelius Ward and Cornelius
Ward Jr. by their Attorneys afd. And hereupon the Said Wards as before defends the force and Injury when &c and
Sayth that they Cannot deny the Action afd. of the afd. Smith Horsey (nor but that the Writing Obligatory afd. is
the deed of them the Said Cornelius Ser & Cornelius Ward Jr. nor but that they Owe the afd. Smith Horsey the afd.
One hundred and four pound Sixteen Shillings Curt Money in Manner and form as the afd. Smith Above Against
them hath declared       Therefore it is Considered that the afd. Smith Horsey Recover Against the afd.
Cornelius Ward & Cornelius Ward Jr his debt afd. and his Damages by Occasion of the detention of that
387    Same debt to                                                 Pounds of Tobacco to the Same Smith of his Assent by the
Court here Adjudged And the afd. Cornelius & Cornelius in Mercy &c

WH    John Cail & P: Walker    Command was Given to the Sheriff of Somerset County that he Should take

@    William Nutter Late of Somerset County Planter Otherwise Called I William Nutter of
LD    Wm. Nutter    Somerset County in the Province of Maryland Planter if he Should be found in his

Bailywick
