June Court 1760 15 County Forrist was Attached to Answer unto Thomas Clarkson of a plea of Trespass upon ye. Case &c. And Whereupon the said Thomas by Littleton Dennis his Attorney Complains that Whereas ye. said David on ye. Eight day of September Anno Dom. MDCCLVi at Somerset County afd. was indebted unto ye. said Thomas in the within sum of four pounds Current money of Maryland for the Article in the Account Annexd. mentioned and so thereof indebted being ye said David in Consideration thereof Afterwards to wit ye. day and year afd. at ye. County afd. upon himself did Assume And to ye. said Thomas then & there faithfully promise that he ye. said David When he should be thereto afterwards required unto ye. said Thomas he would faithfully pay and Content Nevertheless the said David his promise and Assumption afd. in form afd. made not regarding ye. sum of money afd. unto ye. afd. Thomas he hath not paid nor him for ye. same in any sort contented but that to do alltogether hath refussed & still doth refusse altho ye. same to do afterwards to wit ye. Day & year afd. at ye. County afd. and often since that time by ye said Thomas required to ye. Damage of ye. said Thomas ten pounds Current money of Maryland & thereof he brings suit &c Pledges &c. J. Doe & Ri: Roe Jenuary 1752 David Wilson Dr. To Thomas Clarkson To 1 horse Sold you att £4..0..0 E Extd pr. Thoms. Clarkson Septr. 8th. 1756 Thomas Clarkson made oath that ye. above Account is just and True and that he hath not derectly nor inderectly to his Knowledge received Any part before me one of his Lordships Justices for Dorcester County Robt. Polk A copy of the foregoing Declaration was made and sent to be served on ye. Deft. in Order for speedy Tryall Att which day here Came ye. afd. Thomas Clarkson by Littleton Dennis his Atty. and ye. sherriffe to witt William Allen Gent. now here returned that he had taken ye afd. David Wilson whose Body here at this day he had ready to Answer ye. afd. Thomas Clarkson of ye. afd. Plea as to him it was Commanded and further ye. same sherriffe returned that he had served ye. afd. David Wilson With a Copy of the foregoing declaration According to Act of Assembly in such Case provided &c. Whereupon ye. said David Wilson at ye. Prayer of ye. afd. Thomas Clarkson is Adjudged to give Special Bail to ye. Action afd. Thereupon a Certain John Huffington of Somerset County Planter Present here in Court in his Proper person undertook for ye. said David Wilson that if it should happen that judment in ye. plea afd. should be rendered for ye. said Thomas Clarkson against ye. afd. David Wilson or that he the said David should be therein Convict that then he the said David should pay and satisfie unto ye. afd. Thomas ye. judgment of ye. court thereupon or render his Body in Execution of such Judgmt. to ye. Prison of ye. sherriffe of ye. County afd. in satisfaction thereof or that he ye. said John Hoffington will do ye. same for him &c. |
