   June Court                  1760                        15
Whereupon ye. said Stephens White Altho Solemnly Called to shew Cause &c. came
not but makes default &c. Whereupon the afd. Thomas Newbold Garnishe of ye.
afd. Stephen White in his proper person Came & the said Thomas Newbold says that
he cannot deny but that he has of ye. rights and Credits of ye. said Stephen White
to the value of seven pounds five shillings Current money nor Can he say but
that the afd. seven pounds five shillings ought to be Condemned in his hands
for the use of ye. said Smith Horsey as of the rights & Credits of ye. said Stephen
White which he the said Smith Horsey do not gainsay &c.
Whereupon ye said Smith Horsey by his Atty afd. Came here into Court and
                 upon
prays that ^ giving Scry According to Act of Assembly in such Case made and
Provided ye severall goods and Chattles so as afd Attached & valued to the sum
of five pounds Currt. money & seven hundred & Twenty five pounds of Tobacco as
appears by ye. appraisment afd. and also ye. sum of seven pounds five shillings Currt.
money so as afd. Confessed by ye. afd. Thomas Newbold Garnishe as afd. may be
Condemned as of ye. goods & Chattles of ye. afd. Stephens White towards satisfieing unto
him ye. said Smith Horsey his Damages and all Costs & Charges accrueing by
means of ye. attachment afd.
Thereupon a certain Samuel Wilson Present here in Court in his proper person
undertakes for the said Smith Horsey According to Act of Assembly that if the said
Stephen White do at any time within a year or a day and make all or any
Part of ye. said Smith Horsey Claim agt. him appear to be satisfied or
otherwise to have been undue before ye. Laying of this attachment that then
he ye. said Smith Horsey shall make restitution to him ye. said Stephen White
of all or such part thereof as shall be made appear to be undue or that he the
said Samll. Wilson will doe ye. same for him &c.
Therefore it is Considered that the severall goods and Chattles so as afd. attached
& valued at five pounds Currt. money & seven hundred & twenty five pounds of
Tobacco and also ye. sum of seven pounds five shillings Curt. money so as
afd. Confessed by ye. afd. Thomas Newbold Garnishe as afd. may be Condemnd.
as of ye. goods & Chattles of ye. afd. Stephen White towards satisfieing unto him
ye. said Smith Horsey his Damages and all Costs and Charges accrueing by
means of ye. attachment afd. & that ye. Smith Horsey have thereof Execution &c

vs    Command was Given to the Sherriffe of Somerset Coty
WH    David Wilson    that he Should take David Wilson Late of Somerset Coty
Forrist if he Should be found in his Bailywick & him Should Safe keep so that he
might have his Body before ye. Justices of his Lordships County Court of Somerset
to be held at Princes Ann Town the third Tuesday of March Anno Dom. one thousand
seven hundred and fifty Eight to Answer unto Thomas Clarkson of a plea of
Trespass upon ye Case &c. And ye same day is Given to ye afd. Thomas here &c.
And thereupon ye. said Thomas Complains against the afd David in ye. plea afd
in form following         Somerset to wit David Wilson Late of Somerset
