                August Court                 1762              156
John Williams    Somerset County to wit The Petition of John Williams of Jones's Creek humbly Sheweth that
      Petn    he is Seized of a tract of Land Called Little Bolton Scituate in the County afd. the bounds
whereof are Precarious and Much decayed and the Witnesses to prove the Same Ancient and infirm
Wherefore he prays Your Worships to Grant a Commission and Appoint Commissioners to take
Depositions Relating to the bounds of the Said Land or of Any other Lands on which the Same may
depend Agreeable to Act of Assembly in Such Case made and provided and Will pray &c
      Whereupon Came here into Court the afd. Petitioner in his proper       John Williams
Person and thereupon the Petition afd. being Read and heard and fully understood it is Considered by
the Court here that a Commission Issue to the afd. John Williams as by the Petition afd. is praid and that
Isaac Coulbourn, James Gunby Josephas Bell and Outerbridge Horsey of Somerset County Gent be Commissioners
and Execute the Same Commission According to Act of Assembly in Such Case Provided &c

@    Command was Given to the Sheriff of Somerset County that he Should take Mitchell
SW    Mitchell King    King Late of Somerset County Planter Otherwise Called me Mitchell King if he Should be
found in his Bailywick and him Should Safe keep so that he might have his body before our Justices of our County
Court of Somerset to be held at Princes Ann Town the third Tuesday of August Anno Dom. one thousand
Seven hundred and Sixty Two to Answer unto Robert Handy of A plea that he Render him the Sum of three
pounds four Shillings and a penny Curt Money of Maryland which to him he Owes and unjustly detains and So forth
And the Same day is Given to the afd. Robert here &c
             And hereupon the Said Robert Declared Against the afd. Mitchell in the plea afd. in
form following       Somerset fst Mitchell King Late of Somerset County Planter Otherwise Called me
Mitchell King was Summoned to Answer unto Robert Handy of A plea that he Render him the Sum of three
pounds four Shillings and a penny Curt Money of Maryland which to him he Owes and unjustly detains and
So forth       And Whereupon the Said Robert by Josiah Polk his Attorney Says that whereas the Said
Mitchell on the thirty first day of May Anno Dom. one thousand Seven hundred and Sixty Two at the County
afd. by his Certain Bill Obligatory which the Said Robert Sealed with the Seal of the Said Mitchell here in Court
Shows whose date is the day and Year afd. Acknowledged himself to be held and firmly bound unto the Said Robert
Handy his heirs or Assigns the full and Just Sum of three pounds four Shillings and a penny Curt Money with
Lawfull Interest for the Same for Value Received to the payment whereof well and truly to be made and done
the Said Mitchell bound himself firmly by the Said Bill Nevertheless the Said Mitchell alltho
often Required the Sum of Money afd. to the afd. Robert he hath not paid Rendred but the Same to him to
Render hitherto hath Gainsayed and Still doth Gainsay to the damage of the Said Robert Six pounds Curt
Money of Maryland and thereof he brings Suit and So forth
                                                                                           Pledges &c. J: Doe & R: Roe
      A Copy of the foregoing declaration was Made and Sent to be Served on the deft. in order for Speedy
tryall       Att which day here Came the afd. Robert Handy by his Attorney afd. And the Sheriff to witt
Ephraim Wilson now here Returned that he had taken the afd. Mitchell King whose body here at this day
he had Ready to Answer the afd. Robert Handy of the afd. plea as to him it was Commanded And further
the Same Sheriff Returned that he had Served the afd. Mitchell with a Copy of the foregoing declaration
According to Act of Assembly in Such Case provided &c
             Whereupon the Said Mitchell King at the prayer of the afd. Robert Handy is Adjudged to
Give Special Bail to the Action afd. Thereupon a Certain Thomas Ralph of Somerset County planter
present here in Court in his proper person undertook for the Said Mitchell King and Assumed upon
himself that if it Should happen that Judgment in the plea afd. Should be Rendred for the Said
Robert Against the afd. Mitchell or that he the Said Mitchell Should be therein Convict that then
he the Said Mitchell Should pay and Satisfie unto the afd. Robert the Judgment of the Court
