This Oak mentioned in the three Last depositions is Entirely Gone but formerly Stood (the place being Shewed to us the
Commissioners by the deponants) on the Side of a Bank on the Westernmost Side of the head of a Gutt about 49 yards to
the Eastward of the old Meeting house
Somerset fst Benjamin Venables Aged as afd. being Sworn on the holy Evangelists of Almighty God this 6th of
May 1758 deposeth and Saith that he was present when the Land Justices were upon the Land Called Diars Lott
And that Richard Ackworth and John Goslee then proved a Spanish Oak (the Stump of Which we are now
at) to be a bounder of the Said Land Called Diars Lott and further this Deponant Saith not

   Pasque Bartlett Aged About 46 being Sworn on the holy Evangelists of Almighty God this 6th day of
May 1758 deposeth and Saith that John Goslin told him this Deponant that he and Richard Ackworth
had proven a Spanish Oak (the Stump of which we are now at) to be a bounder of a tract of Land belonging
to Capn. Joseph Venables and further Saith not

Thomas Dashiell    Somerset fst Frederick Absolute Lord and Propry of the provinces of Maryland and Avalon
   Commission    Lord Baron of Baltemore &c. To Ephraim King, George Gale, George Scott and Alexr. Roberson of
Somerset County Gentlemen Greeting know ye that we have Appointed you or Any three or two of you to be our
Commissioners to Examine Evidences on behalf of a Certain Thomas Dashiell of Somerset County in Relation to
the Bounds of a tract of Land Called Becknam or Any other Lands on which the Bounds of the afd. Land may depend
We therefore Required you or Any three or two of You at Some time and place as to You or Any three or two of you
Shall Seem Convenient you meet on the afd. Land Called Becknam or Any other Land on which the bounds of the
afd. Land may depend You first haveing taken Your Oaths on the holy Evangels of Almighty Got and there Cause to
Come before you or Any three or two of you all Such Evidences as Shall be to You or Any three or two of you Nominated
by the Said Complainant or Deft. and that you or Any three or two of you Examine them upon their Corporall Oaths
to be by you or Any three or two of You Administred on the holy Evangelist of Almighty God in the presence of the
Complainant or deft. if any touching the truth or Remembrance of their knowledge or Any thing that may Relate to
the Cause afd. and that Reduceing the Severall depositions into Writing you Send the Same with this our
Commission under your or Any three or two of Your hands and Seals to us to our County Court of Somerset with all
Convenient Speed Witness Isaac Handy Esqr one of our Justices of our Said Court the 18th day of June Anno Dom. 1761
           And now to witt at a Court of his Lordship held at Princes Ann Town the third Tuesday of June being the
Eighteenth day of the Same month Anno Dom. 1762 before the Justices thereof Came Ephraim King and George
Gale two of the Gent nominated in the within Commission and Returned the Same Endorsed in Manner following
with the Severall depositions thereto Annexed
   Augt. 10th: 1761 Then was the within named Ephraim King Sworn on the holy Evangels of Almighty God in due
form of Law to Execute the within Commission                      before me       Eph: Wilson
Sepr. ye. 11th: 1761 Then was the within Named George Gale Sworn on the holy Evangels of Almighty God in due
form of Law to Execute the within Commission before me                   Eph: King
   Somerset fst We the Subscribers two of the persons Appointed on the within Commission to Examine Evidences in
Relation to the bounds of the Lands therein Mentioned do hereby Certify that being thereto Qualified and
having Given the proper notice According to Law we met on the Said Lands on the 6th day of October Anno Dom. 1761
And took the depositions hereto Annexed Witness our hands and Seals                           Ephm. King

Samuel Flewelling Aged Sixty Seven being Sworn on the holy Evangelist of Almighty God deposeth as followeth
that About Twelve or thirteen Years Ago Francis Lank brought him this Deponant to this Red Oak where we now are
And told him that the Said tree was Old Mr. Dashiells's Second Bounder of a tract of Land that he had taken up
And further Saith not                                                                                         Samuel Fluellin
      Levin Dashiell Aged About fifty Years being Sworn on the holy Evangelist of Almighty God deposeth as followeth
that About Twenty Years Ago Henry Dashiell Senr. told this Deponant that this tree that we are now at was the
