June Court 1762 145 Offending Contrary to the peace of the Said Lord Propry that now is his good Rule and Government and Against the form of the Act of Assembly in Such Case made and provided &c. Whereupon the Same Attorney of the Same in this part Lord Propry for the Said Lord Propry prays Advice of the Court here in the premisses and that due process of Law may ^ be made Against the Said Rachell to Answer of and upon the premisses and So forth Thereupon it is Commanded the Sheriff of Somerset County that he Should take the Said Rachell Benston if She Should be found in his Bailywick and her Should Safe keep so that he might have her body before the Justices of his Lordships County Court of Somerset to be held at Princes Ann Town the third Tuesday of June Anno Dom. one thousand Seven hundred and Sixty Two to Answer unto his Said Lordship of and Concerning the Information &c. Att which day here Came the afd. Rachell Benston in her proper person and had a hearing of the Information afd. Saith that She Cannot deny but that She is Guilty of the premisses in the Information afd. mentioned upon her Imposed in Manner and form as by the Information afd. Above Against her Supposed but will not declare the father but is willing to pay her fine for the Same According to Act of Assembly in Such Case provided &c. Whereupon all and Singular the premisses being Seen and by the Court fully understood it is Considered by the Court here that the afd. Rachell Benston for the premisses and Offence afd. in the Information afd. be taken &c. which Said Rachell Benston present here in Court in her proper person is fined for the Offence afd. the Sum of three pounds Curt Money which She paid here in Court to the Sheriff for the use of the County &c Whereupon the Said Rachell Benston is ordered to Give Security to Save and keep Indemnified the Justices of Somerset County Court from all Costs Charges and troubles that may Accrew by means of the Birth of the Bastard Child afd. Thereupon the Said Rachell Benston with Michael Holland of Somerset County planter her Security both present here in Court in their proper persons Acknowledged themselves Indebted unto Goods or Chattles Lands and Tenements Joyntly and Severally to the use of his Said Lordship his heirs and Successors to be made and Levied if it happen that the afd. Rachell Benson do not Save and keep Indemnified the Justices of Somerset County Court from all Costs Charges and troubles that may Accrew by means of the Birth of the Bastard Child afd. &c
Thos. Eliner Oney for the Offence afd. be taken which Said Elinor Oney present here in Court is fined the Sum of three pounds Curt Money which She paid down to the Sheriff for the use of the County &c Whereupon the Said Eliner Oney is Ordered to Give Security to Save and keep Indemnified the Justices of Somerset County Court from all Costs Charges and troubles that may Accrew by means of the birth of the bastard Child afd. Thereupon Proper Person undertook for the Said Eliner Oney and Acknowledged himself to be held and firmly bound unto and Tenements to the Use of his Said Lordship his heirs and Successors to be made and Levied if it happen that the Said Joseph Weatherly do not Save and keep Indemnified the Justices of Somerset County Court from all |
