June Court 1762 141 not Regarding the afd. Sum of Nine pounds fifteen Shillings and one penny Curt Money afd. to the afd. Alexander he hath not paid nor him for the Same in Any Sort Contented but that to doe altogether hath Refused and Still doth Refuse altho the Same to time by the Said Alexr. Required to the damage of the Said Alexr. Twenty Pounds Curt Money of Maryland and thereof he brings Suit &c. Pledges &c. J: Doe & R: Roe
thereof to Imparle here untill next Court to be held at Princes Ann Town the third Tuesday of March then next following and he hath it and the Same day is Given to the afd. Alexander here also &c Att which day here Came as well the afd. Alexr. Stuart as the afd. Thomas Ackworth by their Attorneys afd. And hereupon the Said Thomas prays further Leave thereof to Imparle here untill next Court to be held at Princes Ann Town the third Tuesday of June then next following and he hath it and the Same day is Given to the afd. Alexr. here also &c Att which day here Came as well the afd. Alexander Stuart as the afd. Thomas Ackworth by their Attorneys afd. And hereupon the Said Thomas as before defends the force and Injury when &c. And Says that he did not Assume upon himself in Manner and form as the afd. Alexander Above Against him hath Complained and of this he puts himself upon the Country &c. And Afterwards in the afd. Court Came the afd. Thomas Ackworth by his Attorney afd. and Relinquisheth his Verification afd. by him above pretended And Saith that he Cannot deny the Action afd. of the afd. Alexr. Stuart nor but that he did Assume upon himself in Manner and form as the afd. Alexr. above Against him hath Complained and as to the damage of the Same Alexander by him by Occasion of the Premisses in that part Sustained the Same Thomas Saith and Acnowledgeth that the afd. Alexr. hath Sustained damages by Occasion of the Premisses beyond his Costs and Charges by him about his Suit in that part Apposed to Nine pounds fifteen Shillings and one penny Curt Money and not More and because the afd. Alexr. denys not this but the Same Allegation Grants to be true prays Judgment for those damages above Acknowledged together with his Costs and Charges afd. to him to be Adjudged Therefore by Consent of the parties afd. it is Considered that the afd. Alexr. Stuart Recover Against the afd. Thomas Ackworth his Damages afd. to the afd. Nine pound fifteen Shillings and One penny Curt Money 220 3/4 Same Thomas in form afd. Acknowledged as also Pounds of tobacco for his Costs and Charges afd. to the Same Alexr. at his Request by the Court now here of the Assent of the parties afd. Adjudged which Certain Damages in the Whole Amount to Nine pound fifteen Shillings and one penny Curt Money & Pounds of Tobacco and the afd. Thomas in Mercy &c
Answer unto Lane Roberson of A plea of trespass upon the Case &c. And the Same day is Given to the afd. Lane here &c Att which day here Came the afd. Lane Roberson by George Hayward his Attorney and the Sheriff to witt Ephm Wilson now here Returned that he had taken the afd. John Jenners whose body here at this day he had Ready to Answer the afd. Lane Roberson of the afd. plea as to him it was Commanded Whereupon the Said John Jenners at the prayer of the afd. Lane Roberson is Adjudged to Give Special Bail to the Action afd. Thereupon a Certain David Polk of Somerset County Gent present here in Court in his proper |
