to witt Levin Dashiell, Revell Horsey, William Polk, Ezekiell Hall, Aaron Starling, John Evans, Ballard
Bozman, Elias White, Robert Dashiell, Jessey King, Joseph Venables, Wm. Waller being Call Came and were Sworn

upon that Jury who to Say the truth of the Premisses afd. being Elected Tryed and Sworn ^ upon their Oath Say that
Ambros Fitzwaters is Guilty of the Premisses in the declaration afd. Mentioned in Manner and form as
the afd. John above Against him hath Complained and Assessed the Damages of the Said John by Occasion of
the Premisses beyond his Costs and Charges by him about his Suit in that part Apposed to five pounds Eight
Shillings and Ten pence half penny Curt Money and for those Costs and Charges to One pound of tobacco
      Therefore it is Considered that the afd. John Donohoe Recover Against the afd. Ambros Fitzwaters
499 3/4    his Damages afd. by the Jurors afd. in form afd. Assessed as also
Pounds of tobacco for his Costs and Charges afd. to the Same John by the Court here of his Assent of Increase
Adjudged which Certain Damages in the Whole Amount to five Pounds Eight Shillings and ten pence half penny
500 3/4    Curt Money and                           Pounds of tobacco and the afd. Ambros in Mercy &c

@    Command was Given to the Sheriff of Somerset County that he Should take
WH    Thomas Ackworth    Thomas Ackworth Late of Somerset County Planter if he Should be found in his Bailywick
and him Should Safe keep so that he might have his body before the Justices of his Lordships County Court of
Somerset to be held at Princes Ann Town the third Tuesday of August Anno Dom. one thousand Seven
hundred and Sixty One to Answer unto Alexander Stuart of A plea of trespass upon the Case &c. And the Same
day is Given to the afd. Alexander here &c
           Att which day here Came the afd. Alexr. Stuart by Josiah Polk his Attorney and the Sheriff
to witt John Dennis Gent now here Returned that he had taken the afd. Thomas Ackworth whose body here
at this day he had Ready to Answer the afd. Alexander Stuart of the afd. plea as to him it was Commanded
        Whereupon the Said Thomas Ackworth at the prayer of the afd. Alexr. Stuart is Adjudged
to Give Special Bail to the Action afd. Thereupon a Certain                   of Somerset County planter
Present herein Court in his Proper Person undertook for the Said Thomas Ackworth and Assumed upon himself
that if it Should happen that Judgment in the Plea afd. Should be Rendred for the Said Alexander
Stuart Against the afd. Thomas Ackworth or that he the Said Thomas Ackworth Should be therein Convict
that then he the Said Thomas Ackworth Should pay and Satisfie unto the afd. Alexr. Stuart the
Judgment of the Court thereupon or Render his body in Execution of Such Judgment to the Prison of the
Sheriff of the County afd. in Satisfaction thereof or that he the Said                                     Will do the
Same for him &c.       Whereupon the Said Thomas Ackworth Puts in his place Wm. Hayward Gent
Attorney at Law Against the afd. Alexr. Stuart of the afd. plea
           And thereupon at the Prayer of the Parties afd. day is to them now here Given untill next Court
to be held at Princes Ann Town the third Tuesday of November then next following in the State that
now Saveing to the Parties afd. &c       Att which day here Came as well the afd. Alexander Stuart as the
afd. Thomas Ackworth by their Attorneys afd. And hereupon the Said Alexr. Complained Against the afd.
Thomas in the plea afd. in form following    Somerset fst Thomas Acworth Late of Somerset County Planter
was Attached to Answer unto Alexander Stuart of A plea of trespass upon the Case and So forth
           And Whereupon the Said Alexander by Josiah Polk his Attorney Complains that Whereas the Said
Thomas on the Twenty Second day of May Anno Dom. one thousand Seven hundred and Sixty one at the
County afd. was Indebted unto the Said Alexander in the Sum of Nine pounds fifteen Shillings and one
penny Curt Money of Maryland for the Articles in the Account hereto Annexed Mentioned and So thereof
Indebted being the Said Thomas on Consideration thereof Afterwards to wit the day and Year afd. at the County
afd. upon himself did Assume and to the Said Alexander then and there faithfully Promise that he the
Said Thomas when he Should be thereto afterwards Required unto the Said Alexander he would faithfully
pay and Content Nevertheless the Said Thomas his Promise and Assumption afd. in form afd. made
