proper person undertook for the Said John Jenners and Assume upon himself that if it Should happen that Judgment
in the plea afd. Should be Rendred for the Said Lane Roberson Against the afd. John Jenners or that he the Said
John Should be therein Convict that then he the Said John Should pay and Satisfie unto the afd. Lane the
Judgment of the Court thereupon or Render his body in Execution of Such Judgment to the Prison of the Sheriff
of the County afd. in Satisfaction thereof or that he the Said David Polk will do the Same for him &c
           Whereupon the Said John Jenners puts in his place Josiah Polk Gent Attorney at Law
Against the afd. Lane Roberson in the afd. plea
           And thereupon at the prayer of the parties afd. day is to them now here Given untill next Court to
be held at Princes Ann Town the third Tuesday of June then next following in the State that now
Saveing to the Parties afd. &c       Att which day here Came the parties afd. by their Attorneys afd. And hereupon
the Said Lane Roberson Complained against the afd. John Jenners in the plea afd. in form following
Somerset fst John Jenners Late of Somerset County Joyner was Attached to Answer unto Lane Roberson
of A plea of trespass upon the Case &c         And Whereupon the Said Lane by George Hayward his
Attorney Complains that Whereas the Said John the xx day of June MDCCLX at the County afd. was Indebted
unto the Said Lane in the Sum of Five pounds Curt Money of Maryland for So much by the Said John before that time
had and Received to the use of the Said Lane and being So Indebted the Said John in Consideration thereof
Afterwards to wit the Same day and Year afd. at the County afd. undertook and then and there faithfully promised
the Said Lane that he the Said John would well and truly pay the Said Sum of five pounds Curt Money of Maryland
to the Said Lane when he the Said John Should be thereto afterwards Required Nevertheless the Said John
not at all Regarding his Promise and undertaking made in form afd. but Contriving and fraudulently
Intending in this behalf Craftily and Subtilly to deceive and defraud the Said Lane hath not paid the Said
Sum of Money or Any part thereof to the Said Lane altho thereunto often Required at the County afd.
but hath Intirely Refused and Still doth Refuse to pay him the Same to the Damage of the Said
Lane ten pounds Curt Money of Maryland and thereof he brings Suit and So forth
                                                                                   Pledges &c. J. Doe & R: Roe
      And the afd. John Jenners by his Attorney afd. Comes and defends the force and Injury when &c. And Says
that he Cannot deny the Action afd. of the afd. Lane Roberson nor but that he did Assume upon himself
in Manner and form as the afd. Lane above Against him hath Complained and as to the damage of
the Said Lane by him by Occasion of the Premisses the Said John Saith and Acknowledgeth that the afd.
Lane hath Sustained Damages by Occasion of the Premisses beyond his Costs and Charges by him about
his Suit in that part Apposed to five pounds Curt Money of Maryland and not More and because the afd.
Lane denys not this but the Same Allegation Grants to be true prays Judgment for those damages above
Acknowledged together with his Costs and Charges afd. to him to be Adjudged
           Therefore by Consent of the parties afd. it is Considered that the afd. Lane Roberson Recover Against
the afd. John Jenners his Damages afd. to the afd. five pounds Curt Money by the Same John in form afd. Acknowledged
117 1/4    as also                                          Pounds of tobacco for his Costs and Charges afd. to the Same Lane
at his Request by the Court now here of the Assent of the parties afd. Adjudged which Certain Damages
in the Whole Amount to five pound Curt Money and                                               Pounds of tobacco and
the afd. John in Mercy &c

WH    Gale & Ponsonby

@    Command was Given to the Sheriff of Somerset County that he Should Take Edward
SW    Edward Holland    Holland Late of Somerset County Planter was Attached to Answer unto John Gale and John Ponsonby
of A plea of trespass upon the Case if he Should be found in his Bailywick and him Should Safe keep so that he
Might have his body before the Justices of his Lordships County Court of Somerset to be held at Princes Ann Town
the third Tuesday of March Anno Dom. one thousand Seven hundred and Sixty Two to Answer unto John Gale and
John Ponsonby of A plea of trespass upon the Case &c. And the Same day is Given to the afd. Gale and Ponsonby
here &c.    Att which day here Came the afd. Gale and Ponsonby by William Hayward his Attorney and the Sheriff
to witt Ephraim Wilson Gent now her Returned that he had taken the afd. Edward Holland whose body here at
