June Court 1760 14 Thereupon a certain Samuel Wilson present here in Court in his proper person und: :ertakes for the said Michael Holland According to Act of Assembly that if the said Stephens White do at any time within a Year or a Day appear and Make all or any Part of the said Michael Holland Claim afd. him appear to be satisfied or otherwise to have been undue before the laying of the attachment that then he ye. said Michael Holland shall make restitution to him the said Stephens White of all such part thereof as shall be made appear to be undue or that for him &c. Therefore it is Considered that the severall goods & Chattles so as afd. attached & Valued at Forty two pounds ten shillings Current money and also ye. sum of four pounds Currt. money so as afd. Confessed by ye. afd. John White Garnishee as afd. may be Condemned as of ye goods & Chattles of ye. afd. Stephens White towards satisfieing unto him ye. said Michael Holland his Damages & all Costs and Charges Accrueing by means of ye. attachment afd. & that ye. afd. Michael Holland have thereof Execution &c.
Sum of Twenty five pounds like money with Legal Interest till paid as witness My hand and seal this 19th. Day of Aprill 1760 testis Stevens White {seal} Patrick Melaly Somerset fst. Smith Horsey this 2d. day of June 1760 made oath on ye. Holy Evangels of Almighty God that Stevens White is indebted to him By the Bill hereto annexed in ye. sum of twelve pounds twelve shillings Current money of Maryland and Interest thereon from ye/ 19 day of Aprill 1760 and that he never recd. any part or parcel security or satisfaction for ye. same & that ye. same remains Bonafied due to him which Bill he produced to me before Robt. Jenckins Henry Somerset fst Whereas I am legally informed that Stevens White hath absconded from Justice and Carried away part of his substance to deceive his Creditors & hath Removed from hi place of abode and it appears to me by ye. Oath above and the Bill hereto annexed that he is indebted unto Smith Horsey in ye sum of twelve pounds twelve shillings Current money of Maryland and Interest thereon from ye. 19th. day of Aprill last by ye. said Bill in ye. penalty of Twenty five pounds Current Money Conditioned for ye. payment of ye. same this is to direct you to Issue an attachment against the Lands Tenements goods and Chattles rights and Credits of ye. said Stevens for ye. said penalty and ye. Incidentall Costs given under My hand this 2d. day of June 1760 Robt. Jenckins Henry By Virtue of the above Warrant & Bill being Proven was Issued the following Attachment Somerset fst |
