March Court 1762 127 Att which day here Came the afd Peter Hubbard by his Attorney afd. and Ephraim Wilson Sheriff of the County afd Returned that he had taken the afd. Samuel Horsey whose body here at this day he had Ready to Answer the afd. Peter Hubbard of the afd. plea as to him it was Commanded Whereupon the Said Samuel Horsey Adjudged to Give Special Bail to the Action afd. Thereupon a Certain Stephen Horsey of Somerset County Planter Present herein Court in his Proper person undertook for the Said Samuel Horsey and Assumed upon himself that if it Should happen that Judgment in the plea afd. Should be Rendred for the Said Peter Hubbard Against the afd. Samuel Horsey or that he the Said Samuel Horsey Should be therein Convict that then he the Said Samuel Should pay and Satisfie unto the afd. Peter the Judgment of the Court thereupon or Render his body in Execution of Such Judgment to the Prison of the Sheriff of the County afd. in Satisfaction thereof or that he the Said Stephen Horsey will do the Same for him &a. And the Said Samuel Horsey in his proper person Comes and defends the force and Injury when &a. And Saith that he Cannot deny the Action afd. of the afd. Peter nor but that he did Assume upon himself in Manner and form as the afd. Peter above Against him hath Complained and as to the Damage of the Said Peter by him by Occasion of the Premisses in that part Sustained the Same Samuel Saith and Acknowledgeth that the afd. Peter hath Sustained Damages by him by Occasion of the Premisses beyond his Costs and Charges by him about his Suit in that part Apposed to Eight pounds Seventeen Shillings and Nine pence half penny Currt Money of Maryland and not more and because the afd. Peter denys not this but the Same Allegation Grants to be true prays Judgment for those damages above Acknowledged together with his Costs and Charges afd. to him to be Adjudged &a Therefore by Consent of the Parties afd. it is Considered that the afd. Peter Hubbard Recover Against the afd. Samuel Horsey his Damages afd. to the afd. Eight Pounds Seventeen Shillings and Nine pence half penny Currt Money of Maryland by the Same Samuel in form afd. Acknowledged as also : Pounds of Tobacco for his Costs and Charges afd. to the Same Peter at his Request by the Court now here of the Assent of the Parties afd. Adjudged which Certain Damages in the Whole Amount to Eight Pound Seventeen Shillings and Nine pence half penny Currt Money of Maryland and 97½: Pounds of Tobacco with Stay of Exn untill the Last day of Aprill and the afd Samuel in Mercy &a
Eliza Tull and a Bastard Child on the body of the Said Eliza. Tull then and there did beget to the high displeasure of Almight God to the Evill Example of all others in Such Case offending and Against the peace of the Said Lord Propry that now is his good Rule and Government and Against the form of the Act of Assembly in Such Case made and Provided and So forth Thereupon it is Commanded the Sheriff of Somerset County that he Should Take the Said Nehemiah Covington if he Should be found in his Bailywick and him Should Safe keep so that he might have his body before the Justices of his Lordships County Court of Somerset to be held at Princes Ann Town the third Tuesday of March Anno Domi. 1762 to Answer unto his Lordship of and Concerning the Indictment afd. &a.
