March Court 1762 127 hitherto hath Refused and Still doth Refuse and unjustly detains Whereupon the Said William Says he hath damage to the Value of Twenty Eight Pounds Curt Money of Maryland and thereof he bring Suit &c Pledgs. &c. J: Doe & R: Roe under And the afd. John Cox held at Princes Ann Town the third Tuesday of November then next following and he hath it and the Same day is given to the afd. William here under of the Sher of the County afd. also &c. Att which day here Came as well the afd. William Geddes by his Attorney afd. as the afd. John Cox ^ that he may be discharged of and from the Commitment afd. for as much as he the Said John Cox is Ready to give unto the Said Wm. Geddes Good and Sufficient Bail in the plea afd. And to Stand and Abide the Judgment of the Court thereupon &c. Whereupon A Certain William Roberson of Somerset County planter present here in Court in his proper person undertook for the Said John Cox and Assumed upon himself H that if it Should happen that Judgment in the plea afd. Should be Rendred for the Said William Geddes Against the afd. John Cox or that he the Said John Cox Should be therein Convict that then he the Said John Cox Should pay and Satisfie unto the afd. Wm. Geddes the Judgment of the Court thereupon or Render his body in Execution of Such Judgment to the prison of the Sheriff of the County afd. in Satisfaction thereof or that he the Said William Roberson will do the Same for him &c And thereupon the Said John Cox is discharged of and from the Commitment afd. &c And thereupon the Said John Cox prays further Leave thereof to Imparle here untill next Court to be held at Princes Ann Town the third Tuesday of March then next following and he hath it And the Same day is Given to the afd. William here also &c. Att which day here Came as well the afd. William Geddes as the afd. John Cox by their Attorneys afd. And hereupon the Said John as before defends the forces and Injury when &c. And Saith that he Cannot deny the Action afd. of the afd. William Geddes nor but that the Writing Obligatory afd. is the deed of him the Said John Cox nor but that he Owes the afd. Wm. Geddes the afd. Twenty Eight pounds Curt Money in Manner and form as the afd. William Above Against him hath declared    Therefore it is Considered that the afd. William Geddes Recover Against the afd. John Cox his Debt afd. and his Damages by Occasion of the detention of that Same debt 241 to Pounds of Tobacco to the Same William of his Assent by the Court here Adjudged And the afd. John in Mercy &c Memd. all the debt Released but One pound fifteen Shillings &c
Tuesday of March Anno Dom. one thousand Seven hundred and Sixty Two to Answer unto Peter Hubbart of A plea of trespass upon the Case &c. And the Same day is Given to the afd. Peter here also &c And hereupon the Said Peter Complained of the afd. Samuel in the plea afd. in form following Somerset fst Samuel Horsey Late of Somerset County Planter was Attached to Answer unto Peter Hubbart of a plea of trespass upon the Case and So forth &5 And Whereupon the Said Peter by George Hayward his Attorney Complains that Whereas the Said Samuel the xxx day of November Anno Dom. MDCCLXI at the County afd. was Indebted unto the Said Peter in the Sum of Eight Pounds Seventeen Shillings and Nine pence half penny Current Money of Maryland for the Sundry Articles and things in the Account hereto Annexed Mentioned and So thereof Indebted being the Said Samuel in Consideration thereof Afterwards to wit the Same day and Year afd. at the County afd. upon himself Assumed and to the Said Peter then and there faithfully Promised that he the Said Samuel the Sum of Money afd. When he Should be thereto afterwards Required unto the Said Peter well and faithfully would pay and Content Nevertheless the Said Samuel his Promise and Assumption afd. in form afd. made Little Regarding but minding and fraudulently Intending the Said Peter in this behalf Craftily ad Subtilly to deceive and defraud the Sum afd. unto the Said Peter hath not paid or him for the Same in Any Sort Contented (Altho the Same to do the Same Samuel afterwards to witt the Same day and Year afd. and often Since at the County afd. by the Said Peter was Required) but the Same to him to pay hitherto altogether hath Refused and Still doth Refuse and unjustly Deny Whereupon the Said Peter Says he is Worse and hath damage to the Value of Twenty Pounds Curt Money of Maryland and thereof he brings Suit and So forth Pledges &c J: Doe & R: Roe |
