Henry and Edward the afd. Eight pounds Curt Money in Manner and form as the afd. Henry and Edward Above Against him have declared Therefore it is Considered that the afd. Henry and Edward Recover Against the afd. Hope Hull their Debt afd. and their Damages by Occasion of the Detention of the Same debt to 3602 Pounds of Tobacco to the Same Henry and Edward of their Assent by the Court here Adjudged and the afd. Hope in Mercy &c. Memd. the Pltfs Releaseth unto the afd. Defendant all the above Debt but principall Sum Interest and Costs &c
the Justices of his Lordships County Court of Somerset to be held at Princes Ann Town the third Tuesday of June Anno Dom. one thousand Seven hundred and Sixty One to Answer unto William Geddes of A plea that he Render him the Sum of Twenty Eight Pounds Curt Money of Maryland which to him he Owes and unjustly detains and So forth and the Same day is given to the afd. William here &c Att which day here Came the afd. William Geddes by George Hayward his Attorney and the Sheriff to witt John Dennis Gent now here Returned that he had taken the afd. John Cox whose body here at this day he had Ready to Answer the afd. William Geddes of the afd. plea as to him it was Commanded Whereupon the Said John Cox at the prayer of the afd. William Geddes is Adjudged to Give Special Bail to the Action afd. Thereupon a Certain William Roberson of Somerset County planter Present here in Court in his Proper Person undertook for the Said John Cox and Assumed upon himself that if it Should happen that Judgment in the plea afd. Should be Rendred for the Said William Geddes Against the afd. John Cox or that he the Said John Cox Should be therein Convict that then he the Said John Cox Should pay and Satisfie unto the afd. William Geddes the Judgment of the Court thereupon or Render his body in Execution of Such Judgment to the Prison of the Sheriff of the County afd. in Satisfaction thereof or that he the Said William Roberson will do the Same for him &c Whereupon the Said John Cox puts in his place William Hayward Gent Attorney at Law Against the afd. Wm. Geddes in the afd. plea And thereupon at the prayer of the Parties afd. day is to them now here Given untill next Court to be held at Princes Ann Town the third Tuesday of August then next following that now Saveing to the parties afd. &c Att which day here Came the parties afd. by their Attorneys afd. And thereupon Roberson Special Bail of the afd. John Cox in his proper person Comes and prays that for his Indemnity he may be discharged of and from his Manucaption and Bail piece afd. Entred into for the Said John Cox Whereupon the Said Wm. Roberson of his Manucaption and Bail piece afd. is discharged &c. Thereupon the Said John Cox being present here in Court in his proper person is Committed to the Custody of John Dennis Gent the Sheriff of the County of Somerset thereto Remain &c. And thereupon the Said Wm. Geddes declared Against the afd. John Cox in the plea afd. in form following Somerset fst John Cox Late of Somerset County Inholder Otherwise Called I John Cox of Somerset County Maryland Inhodler was Summoned to Answer unto William Geddes of A plea that he Render him the Sum of Twenty Eight pounds Current Money of Maryland which to him he Owes and Unjustly detains and So forth And Whereupon the Said William Geddes by George Hayward his Attorney Says that Whereas the Said John Cox on the tenth of July Anno Dom. one thousand Seven hundred fifty and Nine at the County afd. by his Certain Writing Obligatory Sealed with the Seal of the Said John here in Court Shews whose date is the day and Year afd. Acknowledged himself to be held and firmly bound unto the Said William in the afd. Sum of Twenty Eight Pounds Curt Money afd. to be paid unto the Said William when he Should be thereto afterwards Required Nevertheless the Said John Altho often Required the afd. Sum of Twenty Eight Pounds Curt Money afd. to the afd. William he hath not Rendred but the Same to him to Render hitherto |
