Whereupon the Said John Owens puts in his place Samuel Wilson Gent Attorney at Law Against the afd.
William Geddes in the afd. plea
      And thereupon at the prayer of the parties afd. day is to them now here Given untill next Court to be
held at Princes Ann Town the third Tuesday of June then next following in the State that now Saveing to
the parties afd. &c.    Att which day here Came the parties afd. by their Attorneys afd. And thereupon Thomas
Holbrook Special Bail of the afd. John Owens prays that for his Indemnity he may be discharged of and from his
Manucaption and Bail piece Entred into for the afd. John Owens Whereupon the Said Thomas Holbrook of his
Manucaption and Bail piece afd. is Discharged and Thereupon the Said John Owens for want of Special Bail
to the Action afd. is Committed to the prison of the Sheriff of the County afd. there to Remain &c And
hereupon the Said William Geddes Complained of the afd. John Owens in the plea afd. in form following
Somerset fst John Owens Late of Somerset County Planter was Attached to Answer unto William Geddes
of a Plea of trespass upon the Case and So forth    And Whereupon the Said William by George Hayward his
Attorney Complains that Whereas the Said John after the first day of May Anno Dom. MDCCV to wit
the xx day of October Anno Dom. MDCCLX at Somerset County afd. did Make his Certain note in Writing
Commonly Called a promissary note which Said note the Said John with his proper name and hand then
and there Subscribed bearing date the Same day and Year Last afd. and the Same note then and there to the Same
William did deliver by which Said note the Said John Owens Promised to Pay or Cause to be paid on Demand
unto the Said William by the name of Wm. Geddes the Sum of three pounds Eleven Shillings and
Nine pence for Value Recd. by Reason whereof as also by force of the Statute in Such Case made and
Provided the Same John became Liable to pay or Cause to be paid to the Said William Geddes the afd.
Sum of three Pounds Eleven Shillings and Nine pence upon Demand According to the tenor of the
Note afd. And the afd. John so thereof Liable being in Consideration thereof Afterwards to wit the Same day
and Year Last afd. at the County afd. upon himself Assumed and to the Same William then and there
faithfully Promised that he the afd. John the Sum of Money afd. upon Demand to the Same when he Should be
thereto afterwards Required to the Same William well and faithfully would pay and Content Nevertheless
the Said John his Promise and Assumption afd. in form afd. made Little Regarding but minding and fraudulently
Intending the Said William Geddes in that part Craftily and Subtilly to deceive and defraud the Sum of Money afd.
unto the Said William hath not paid or him for the Same in Any Sort Contented (Altho the Same to do the Same John
afterwards to wit the Same day and Year Last afd. and often Since at the County afd. by the Said William was
Required) but the Same to him to pay hitherto Altogether hath Refused and Still doth Refuse and unjustly
deny Whereupon the Said William Says he is Worse and hath damage to the Value of Ten pounds Curt Money of
Maryland and thereof he brings Suit and So forth                                          Pledges &c. J: Doe & R: Roe
        And the afd. John Owens by his Atty afd. Comes and defends the force and Injury when &c. And prays
Leave thereof to Imparle here untill next Court to be held at Princes Ann Town the third Tuesday of August then
next following and he hath it and the Same day is Given to the afd. Wm here also &c
      Att which day here Came as well the afd. Wm. Geddes as the afd. John Owens by their Attorneys afd.
And hereupon the Said John Prays further Leave thereof to Imparle here untill next Court to be held at
Princes Ann Town the third Tuesday of November then next following and he hath it and the Same day is given
to the afd. William here also &c
           Att which day here Came as well the afd. Wm. Geddes as the afd. John Owens by their
Attorneys afd. And hereupon the Said John Prays further Leave thereof to Imparle here untill next
Court to be held at Princes Ann Town the third Tuesday of March then next following and he hath it and the
Same day is Given to the afd. William here also &c
        Att which day here Came as well the afd. William Geddes as the afd. John Owens by
their Attorneys afd. And hereupon the Said John as before defends the force and Injury when &c
