Jonathan Sott    Whereupon the Said Daniel Smith altho Solemnly Called

Thos. Irving    to Shew Cause Came not but makes default &c

Mathew Cannon    Thereupon the Said James Houston by his Attorney afd.
Came here into Court and prays that upon Giving Security According to Act of Assembly in Such Case
made and Provided the Severall Goods and Chattles so as afd. Attached and Valued to five pounds
Sixteen Shillings and Six pence and five hundred and Seventy pounds of Tobacco as Appears by the
Appraisment afd. may be Condemned as of the Goods and Chattles of the afd. Daniel Smith towards
Satisfying unto him the Said James Houston his Damages and all Costs and Charges Accrewing
by Means of the Attachment afd.    Thereupon a Certain George Hayward present herein Court
                                                                    James Houston
in his proper Person undertakes for the Said ^ Daniel Smith ^ According to Act of Assembly that
if the Said Daniel Smith do at Any time within a Year and a day Make all or Any part of the
Said James Houstons Claim against him Appear to be Satisfied or Otherwise to have been undue
before the Laying of this Attachment that then he the Said James Houston Should make
Restitution to him the Said Daniel of all or Such part thereof as Shall be made Appear to be
undue or that he the Said George Hayward will do the Same for him &c.
           Therefore it is Considered that the Severall Goods and Chattles So as afd. Attached and
Valued at five pounds Sixteen Shillings and Six pence Curt Money & five hundred and Seventy pounds
of Tobacco be Condemned as of the Goods and Chattles of the afd. Daniel Smith towards
Satisfying unto him the Said James Houston his Damages and all Costs and Charges
Accrewing by means of the Attachment afd. and that the afd. James have thereof Execution &c

@    Command was Given to the Sheriff of Somerset County that he Should take
WH    John Cox    John Cox Late of Somerset County Inholder if he Should be found in his Bailywick &
him Should Safe keep so that he might have his body before the Justices of his Lordships County Court
of Somerset to be held at Princes Ann Town the third Tuesday of March Anno Dom. One thousand
Seven hundred and fifty Nine to Answer unto Mary Whittingham of A plea of trespass upon the
Case &c. And the Same day is Given to the afd. Mary here &c
           Att which day here Came the afd. Mary Whittingham by Littleton Dennis his Attorney &
the Sheriff to Witt William Allen Gent now here Returned that he had taken the afd. John Cox whose
body here at this day he had Ready to Answer the afd. Mary Whittingham of the afd. plea as to him it was
Commanded       Whereupon the Said John Cox puts in his place Wm. Hayward Gent Attorney at Law
Against the afd. Mary Whittingham in the afd. plea
           And thereupon at the prayer of the Parties afd. day is to them now here Given untill next
Court to be held at Princes Ann Town the third Tuesday of June then next following in the State that
now Saveing to the parties afd.
      Att which day here Came the Parties afd. by their Attorneys afd. And hereupon the Said Mary
Whittingham Complained of the afd. John Cox in the plea afd. in form following
Somerset to witt John Cox Late of Somerset County Inholder was Attached to Answer unto Mary Whittingham
of A plea of trespass upon the Case &c         And Whereupon the Said Mary by Littleton Dennis her
