Satisfaction or Security for the Account as here Stated before Wm. Winder Somerset fst Whereas it is Made Appear to my Satisfaction by the Oath of James Houston that Daniel Smith is Justly Indebted unto him in the Sum of four pounds ten Shillings and Nine pence and hath Absconded And fled from Justice and hath or is About to Remove his Effects in Order to defraud his Just Creditors These are therefore in his Lordships Name to Authorize and Require you to Issue an Attachment for the Said James Houston Against the Goods Chattles Rights and Credits of the afd. Daniel Smith for the afd. Sum of four pounds ten Shillings and Nine pence with the Incident Costs thereon and this Shall be your Warrant Given under my hand and Seal this Ninteenth day of November in the Year of our Lord One thousand Seven hundred and Sixty One Wm. Winder To the Clk of Somerset County By Virtue of the Above Warrant and Account Proven was Issued the following Attachment Somerset fst Frederick Absolute Lord and Propry of the Provinces of Maryland and Avalon Lord Baron of Baltemore &c. To the Sheriff of Somerset County Greeting we Comman You that You Attach Any the Goods Chattles & Credits of Daniel Smith Late of Somerset County Planter if they Shall be found in Your Bailywick to the Value of Four Pounds Ten Shillings and Nine pence Curt Money and Five hundred Pounds of Tobacco and When you have the Same Attached or Any Part thereof the Same in Your Custody Safe keep so that You have the Same before our Justices of our County Court of Somerset to be held at Princes Ann Town the third Tuesday of March Next then and there to be Condemned According to Act of Assembly to and for the use of a Certain James Houston Unless the Said Daniel Smith by himself or his Attorney Shall Appear and Answer unto the Said James the Houston in A plea of trespass upon ^ Case &c. According to Law and that by Good and Lawfull men of Your Bailywick You Make known unto the Person or Persons in Whose hands You make the Same Attachment that he She or they be and Appear before our Justices of our County Court of Somerset to be held as afd. to Shew Cause if Any he She or they have Why the Same Goods Chattles and Credits So Attached in his her or their hands Ought not to be Condemned and Execution thereof had and Made According to Act of Assembly in Such Case Made and Provided if to him her or them is Shall Seem Meet and how you Shall Execute this Writt that you Make known unto our Said Justices at the day and place afd. and have you then & there this Writt Wittness Isaac Handy Esqr Chief Justice of our Said Court the 21st day of Novr Anno Dom. 1761 Att which Said Third Tuesday of March and Year afd. Came the afd. James Houston by George Hayward his Attorney and the Sheriff to witt Ephraim Wilson now here Returned the afd. Writt of Attachment Indorsed in Manner following with a Schedule thereto Annexed Somerset fst By Virtue of the Within Writt to me directed I hereby Certifie the Justices therein Mentioned I have Attached of the Goods and Chattles of the within Daniel Smith to the Amount of five Pounds Sixteen Shillings and Six pence Curt Money and five hundred and Seventy Pounds of Tobacco as Appears by the Schedule of the Same hereto Annexed which I have here Ready for the purposes in the Same Writt Mentioned So Answers Ephraim Wilson Shef A Schedule of Goods and Chattles belonging to Daniel Smith And Attached |
